Job Title: General Counsel
Job Responsibilities:
The General Counsel is tasked with the management and oversight of all legal affairs for the organization and its related entities. This includes handling contracts, regulatory and compliance issues, corporate governance, litigation management, patient care and collection issues, as well as Medicare and Medicaid appeals, business transactions, and employment matters. The primary responsibilities include:
- Providing legal advice and counsel to organization and business leaders on a wide variety of issues. This encompasses general healthcare law, including Stark Law, anti-kickback statutes, patient issues, and fraud and abuse laws. Additional responsibilities include advising on facility licensure, data privacy and security, risk management, regulatory and compliance issues, business initiatives and transactions, and contract matters.
- Representing the organization in Medicare and Medicaid appeals and other litigation as assigned.
- Managing the contracting process for the organization and related entities. This involves contract review, drafting, negotiation, and execution.
- Overseeing and monitoring all lawsuits and legal matters handled by outside counsel. This includes managing and accounting for outside legal counsel spend.
- Managing the Medicare and Medicaid appeals process, including representing the organization at appeal hearings. The role may also require representing the organization in agency matters and litigation as assigned.
- Monitoring proposed regulatory changes and pending litigation at both the state and federal levels. Advising organization and system leaders of changes that will impact operations and creating summaries of new laws and regulations as necessary to assist leaders and managers with maintaining compliance.
Education and Experience Information:
The candidate must possess a Juris Doctor degree from an accredited law school and be admitted to the Nebraska State Bar Association. A minimum of five years of experience as corporate counsel or in a health law-related legal practice is required. The candidate should have in-depth knowledge of state and federal legal and regulatory issues that affect healthcare. They must have the ability to perform legal research and analysis, prepare legal documents, and provide legal representation. Experience in making solid judgment calls under pressure and the ability to work well both independently and as part of a team is essential. The role demands a practical and proactive legal counsel with excellent analytical and problem-solving skills. Background checks will be conducted as part of the hiring process.
