**Job Title: Deputy General Counsel**

**Job Responsibilities:**
The Deputy General Counsel is responsible for providing legal expertise within the Department of Human Services (DHS) to support its mission of serving individuals with disabilities and aging populations. The role includes advising multiple divisions, ensuring regulatory compliance, and representing the department in various legal proceedings. Key responsibilities include:

- Providing legal counsel on matters related to disability, guardianship, and Medicaid.
- Representing the department in administrative hearings and other legal proceedings.
- Assisting with guardianship and conservatorship cases.
- Overseeing compliance with federal and state regulations, including HIPAA and Medicaid waivers.
- Managing open records requests and ensuring adherence to public records laws.
- Conducting legal research and drafting memoranda, policies, and legal opinions.

**Education and Experience Information:**
Candidates for the Deputy General Counsel position must have a Juris Doctorate (JD) degree and be licensed to practice law in South Dakota. The ideal candidate will have 1-5 years of experience, particularly with knowledge of disability laws, guardianship laws, and Medicaid. A strong desire to serve individuals with disabilities or aging populations is essential.

**Knowledge, Skills, & Abilities:**
- Strong legal research, writing, and analytical skills.
- Ability to assess legal risks and provide clear, practical guidance.
- Knowledge of intellectual and developmental disabilities law, guardianship law, and Medicaid regulations.
- Ability to explain legal concepts clearly to non-legal professionals.
- Experience handling administrative hearings and regulatory compliance matters is considered beneficial.

**Salary Information:**
The annual salary for the Deputy General Counsel position ranges from $87, to $102,, depending on qualifications.

**Additional Requirements:**
Candidates are required to attach a resume and a Legal Brief writing sample. This position is exempt from the Civil Service Act, and the State of South Dakota does not sponsor work visas.
