## Summary

This position is for a senior level attorney who provides support to the General Law I – Toll Group supervisor, Executive Assistant General Counsel, and the Deputy General Counsel/ Unit Chief General Law I Tower. This position is responsible for rendering toll-related legal advice to TBTA and MTA in connection with wide ranging toll-related matters, projects and initiatives, as well as handling non toll-related legal matters which are of significant legal importance to the General Law I Tower, the MTA and its agencies.

## Responsibilities

- Provide legal advice, direction and representation regarding tolling policy including, but not limited to, toll increases and rebates/discount plans, open road Cashless Tolling (ORT), Central Business District Tolling Program (CBDTP), one-way tolling, compliance with the State Administrative Procedure Act (SAPA) and the State Environmental Quality Review Act (SEQRA) and privacy issues.
- Provide legal advice, direction and representation regarding toll related matters involving other tolling and public agencies including, but not limited to, the E-Z Pass Interagency Group, the New York/New Jersey tolling agencies, national toll interoperability, joint legislation, subpoenas, and investigations by other public agencies.
- Provide legal advice and direction regarding toll collection and violation enforcement under ORT and CBDTP including, but not limited to, legislative initiatives, registration suspension, criminal prosecutions, exclusion orders, etc.
- Coordinate with and aid outside counsel retained to collect unpaid tolls and violation fees. On occasion may be asked to directly handle civil litigation, from inception (drafting and preparing complaints for filing and service) through trial/settlement and appeal, and other efforts to collect unpaid tolls and violation fees from scofflaw toll violators.
- Handle non-toll related legal matters which are of significant legal importance to MTA agencies including, but not limited to, matters in the areas of legislation, corporate policies and procedures, regulatory matters, and required governmental filings/submissions.
- Prepare/negotiate various agreements, MOU’s and NDAs between one or more MTA agencies and third parties or government/municipal agencies, as well as perform legal research related to a myriad of topics which impact one or more MTA agencies.
- Perform other assignments as requested.

## Desired Qualifications

- The matters of the MTA are often very complex from a legal perspective. The incumbent will face in-depth problems and will be expected to provide a high level of expertise in various legal matters.
- The incumbent will be responsible for drafting, negotiating, reviewing, executing, and enforcing multimillion-dollar agreements with third parties and in coordination with other MTA agencies.
- This position will advise, orally and in writing, Senior Management and User Departments regarding business and policy issues.
- The incumbent is expected to be a self-starter and show a high degree of initiative and drive, offering assistance and identifying issues at the earliest possible stages.
- The incumbent will often have to work under pressure and meet tight deadlines and is expected to troubleshoot and recommend viable solutions to legal issues.

## Education and Experience

- Juris Doctor degree from an accredited law school; New York State Bar admission and license to practice law maintained in good standing throughout employment.
- In addition, a minimum of six years of general legal experience, preferably mostly in the public sector, is required.
- A background with significant civil litigation and/or strong transactional experience is required.
- A background in toll-related matters is preferred.
