Job Title: Law Clerk 2025 - 2026

Job Responsibilities:
Law clerks in the **Members Only** are responsible for a variety of tasks depending on the court in which they serve. Their primary duties include conducting legal research, preparing legal memoranda, and assisting judges with case management. Specific responsibilities vary by court division:

1. Supreme Court: Law clerks work with justices on complex cases involving difficult legal issues. They perform legal research, prepare written memoranda on novel issues of law, and assist in the preparation of opinions.

2. Appellate Division: Clerks conduct research, analyze legal data, prepare legal memoranda, process emergent motion applications, and proofread published opinions. They must be skilled in writing and editing and have knowledge of Bluebook rules.

3. Superior Court (Trial Court): Clerks gain practical experience by observing judicial proceedings, attending conferences with attorneys and judges, receiving mediation training, and summarizing information for judges. Specific tasks may include preparing bench memoranda for motions, drafting legal orders, and managing the motion calendar.

4. Tax Court: Clerks perform duties similar to those in the Appellate Division and trial courts but focus on judicial tax challenges. They review and process motions, conduct legal research, and draft legal documents related to tax cases.

5. Assignment Judges: Clerks assist with court administration and processing emergent motions. They conduct research, prepare legal memos, and manage the judge’s docket.

6. Family Division: Clerks handle cases involving children, youth, spouses, and domestic partners. They conduct legal research, assist with remote proceedings, and communicate with litigants and attorneys.

7. Civil Division: Clerks prepare bench memoranda, draft legal orders, and manage the motion calendar. They gain exposure to a broad range of legal issues and differing styles of practicing attorneys.

8. Criminal Division: Clerks conduct legal research for opinions and motions, assist in drafting jury instructions and legal opinions, and manage the motion calendar.

9. General Equity (Chancery): Clerks conduct legal research, review case files, draft orders, and assist in processing emergent temporary restraining order applications.

Education and Experience Information:
Applicants must have graduated from a law school approved by the American Bar Association by the time of their law clerk appointment. The program is intended for recent law school graduates, defined as those graduating within the last four years. Excellent writing and analytical skills are essential. It is beneficial to have completed a course in mediation before the start of the clerkship. Selected candidates must provide an official, final law school transcript at the time of hire.

Salary Information:
Salaries for the 2025-2026 Court Term are to be determined based on funding availability. Salaries for the 2024-2025 Court Term are as follows:

- Supreme Court: $76,400
- Supreme Court Appellate Division: $69,750
- Superior Court Assignment Judge: $63,950
- Superior Court Chancery Division (General Equity): $63,950
- Superior Court Law Division (Civil and Criminal): $58,900
- Superior Court Chancery Division (Family): $58,900
- Tax Court: $58,900

Additional Information:
The **Members Only** offers a hybrid work schedule, allowing up to four days per month of remote work outside of Judiciary buildings, subject to certain conditions. Law clerks may hold outside employment with prior approval, as per the Code of Conduct for Judiciary Employees. A valid New Jersey driver's license is required if the operation of a vehicle is necessary for the position. US citizenship is not required, but candidates must be authorized to work in the US. A thorough background check, including fingerprinting, is mandatory for selected candidates. Law clerks are not subject to the New Jersey residency law during their court term but must be mindful of residency requirements if moving into another state position following their clerkship.
