Job Title: Associate Counsel
Job Responsibilities:
The Associate Counsel, Risk & Claims, is tasked with overseeing a team that manages risk and defends against professional liability (malpractice) claims and litigation. This role is integrated with the Claims and Litigation Team within the Legal Department and involves close collaboration with others in the department. The primary responsibilities include leading Risk & Claim operations, managing the defense of professional liability claims and litigation, and supervising a team of risk and claims managers. The Associate Counsel ensures the integrity of claim processes, develops and implements best practices, adheres to claim reporting requirements, and tracks claim and litigation trends. The role also involves contributing to effective communication of claims trends, budget compliance, upcoming trials, lessons learned, early resolution and disclosure programs, and other risk-related issues, projects, and programs.
Key duties include:
- Overseeing a large volume of professional liability claims and other civil litigation.
- Supervising and managing claims and risk staff, and working with in-house and outside counsel to complete projects and outcomes.
- Assisting with claim and risk management strategies, goals, initiatives, and metrics, and communicating trends and comparisons to industry information.
- Coordinating management of claims and litigation with the VP/Chief Litigation Officer and other Legal Department members.
- Participating in the coordination of insurance coverage and coverage analyses, and producing coverage verifications and claim histories.
- Maintaining claims and litigation best practices for professional liability claims and defense.
- Collaborating closely with other team members and internal departments to implement early resolution initiatives and share claims information and trends.
- Sharing trends and claim information with other internal departments, including board reports, upcoming trial dates, metrics, lessons learned, and significant risk issues.
- Supporting legal privileges in claims and litigation, including patient safety work product, attorney-client privilege, and insurer-insured privilege.
Education and Experience Information:
Minimum Qualifications:
- Education: Juris Doctorate required.
- Experience: A minimum of five years of experience as a practicing attorney, including experience in a law firm defending Medical Malpractice/Professional Liability cases. Experience in healthcare risk management, insurance claims, or other litigation, especially with a clinical background, is highly valued.
- Licensure: Membership in an applicable state Bar.
Preferred Qualifications:
- Education: CPCU, CPRHM.
- Experience: Experience in claims and litigation management, healthcare risk management, liability insurance management, clinical experience, and leadership in a healthcare setting.
Required Skills & Knowledge:
- Practicing attorney with trial and case management experience.
- Strong analytical skills and knowledge of medical malpractice defense, clinical risk management, and liability insurance policy provisions and coverage.
