Senior Legal Counsel - Minneapolis, MN

Job Summary:

Coloplast is seeking a highly experienced Senior Legal Counsel to join our North America Legal team. In this role, you will serve as the primary legal advisor to leaders and employees within the North America Chronic Care, Wound & Skin Care, Interventional Urology, Voice & Respiratory Care, and Durable Medical Equipment provider businesses. You will use your broad legal background and subject matter expertise to collaborate with other functional experts and stakeholders to ensure that material legal issues are identified, communicated, and resolved efficiently.

Essential Duties and Responsibilities:

- Serve as primary legal counsel and chief legal advisor to leaders in assigned business areas
- Provide legal advice, guidance, and support to business clients
- Proactively and independently communicate legal matters and projects to leaders and stakeholders and influence decision making
- Advise other functions and the Compliance Department on their policies
- Identify gaps and opportunities for improvement within assigned areas and assist in implementing improvements
- Participate in business projects to advance legal and business objectives
- Assess legal risks and develop risk mitigation strategies in collaboration with the business and other support functions
- Communicate with external third parties regarding legal claims, promotional issues, best practices, and contract negotiations
- Manage and direct efforts of outside counsel
- Review and negotiate a variety of contracts and agreements, including supply, distribution, insurance, marketing, and employment agreements
- Advise on promotional materials, marketing and physician relations programs, and patient education programs
- Integrate with the business to provide practical legal guidance and solutions
- Identify, create, and implement best practices for contract preparation and negotiation

- Approve contracts
- Approve promotional materials and programs

Job Qualifications:

- Juris Doctorate from a US accredited law school
- Licensed attorney in the US and able to be admitted to the Bar in Minnesota
- Minimum 8-10 years of legal experience as a practicing attorney
- Working knowledge of industry-specific legal issues in Coloplast's businesses
- Experience negotiating and drafting commercial contracts
- Previous in-house experience preferred
- Previous experience in medical device, pharmaceutical, or healthcare provider industries preferred
- Experience providing legal advice and support for a healthcare provider, medical device company, or pharmaceutical company preferred
- Experience providing legal advice in the following areas preferred: promotional materials for a medical device or pharmaceutical company, Anti-kickback statute, FDA regulatory issues, Medicare billing issues for a healthcare provider
- Ability to travel up to 15% of the time

- Strong understanding and ability to analyze complex legal and business issues
- Excellent written and oral communication skills for all levels of the organization
- Proactive, flexible, responsive, and resourceful
- Demonstrated ability to work independently and collaboratively
- Strong negotiation and contract drafting skills
- Good stakeholder management skills
- Experience and proficient knowledge in at least five of the following legal areas: Anti-kickback statute, False Claims Act, HIPAA and Privacy issues, FDA and Regulatory law, Clinical trials, Reimbursement issues, Marketing and Promotional issues, Discount Safe Harbor, and Government Investigations

Skills:
