Overview:

The Department of Industrial Accidents (DIA) is seeking a motivated and experienced Workers' Compensation Attorney for the position of Counsel II in their Office of Legal Counsel. The DIA is responsible for administering the Commonwealth's Workers' Compensation System and providing prompt and fair compensation to victims of occupational injuries and illnesses. The successful candidate will be based in the DIA's Boston office and will work under the direction of the DIA General Counsel to investigate, defend, resolve, and handle claims brought against the Workers' Compensation Trust Fund (WCTF). This position offers an opportunity to work on a variety of legal matters and cases, as well as the potential for a hybrid work schedule after a probationary period.

Responsibilities:

- Preparing case files and evidence concerning alleged disability, initial liability, and other issues and defenses relative to assigned claims
- Conducting legal research and communicating the results in writing and orally
- Coordinating activities of the Trust Fund Investigation Unit on assigned claims
- Negotiating agreements and settlements and obtaining authority for same from the General Counsel
- Drafting correspondence, reports, etc. as required
- Conducting ongoing training for in-house staff as appropriate
- Consulting with the Office of the Attorney General and the Office of the District Attorney on criminal actions
- Other related duties as assigned by the General Counsel

Preferred Qualifications:

- Knowledge of theory, principal, and practices of law, with a special emphasis on Workers' Compensation and litigation generally
- Trial experience and knowledge of both civil and criminal courtroom proceedings
- Strong background in tort and administrative law
- Strong negotiation background and abilities
- Strong interpersonal and analytical skills
- Ability to research and write legal opinions, briefs, and other documents
- Ability to manage a case load and court calendar independently
- Knowledge of terminology, symbols, and standard abbreviations used in legal practice
- Knowledge of medical terminology
- Fluency/proficiency in one or more languages in addition to English
- Appellate experience

Qualifications:

- Juris Doctor (JD) degree
- Admission to the Massachusetts Bar
- At least three years of full-time, or equivalent part-time, professional experience in the practice of law
