ProfileCounsel, Marketing, Ip & Privacy The candidate will be responsible, together with a small team of attorneys, for handling all phases of legal work in the areas of marketing, advertising and privacy for the various brands owned by Restaurant Brands International, Inc., one of the largest quick service restaurant companies in the world. The attorney will have primary responsibility for privacy matters and will act under the direct supervision of the Lead Counsel, Marketing & Trademarks. Counsel and advise marketing and restaurant technology departments on data privacy, security and accessibility matters particularly with respect to consumer-facing websites and apps, including compliance with U.S. laws (e.g., CAN-SPAM Act, TCPA, COPPA, ADA). Draft and negotiate various marketing, public relations and promotions-related agreements, including advertising agency agreements, trademark licenses, promotion and sponsorship agreements, media buying agreements, professional services agreements, and vendor agreements. Counsel and advise business clients on legal and business strategies regarding creation and development, implementation and deployment of various marketing activations. Review and approve advertising, promotional and communication materials originating from the marketing and communications departments, as well as external agencies for legal compliance before such materials are communicated to the general public. Draft and review company policies with respect to marketing and privacy matters. Support other attorneys and paralegals with respect to clearance, registration, maintenance, prosecution, and enforcement of the various trademark and domain name portfolios of each RBI brand. Manage and monitor litigation with respect to marketing and privacy matters. Ensure compliance with company policies, procedures and applicable laws. Perform other general legal duties and functions as may be assigned or required by business needs.
Qualification and Experience
A Juris Doctor of Law degree from an accredited U.S. law school required. Must be member in good standing of the Florida Bar or eligible for Authorized In-House Counsel status. 5-7 years of legal experience, law firm experience required. Should have transactional experience with strong drafting and negotiating skills, Knowledge of marketing, intellectual property and U.S. privacy laws is required. Knowledge of international privacy laws is preferred.
