A law firm seeking a Healthcare/Commercial Litigation Attorney in Roseland, NJ. The Healthcare/Commercial Litigation Attorney will represent healthcare professionals, practices, facilities, and other healthcare entities in healthcare-related and commercial litigation matters. They will demonstrate strong writing skills and extensive experience in healthcare-related and commercial litigation, providing legal advice, developing legal strategies, and managing matters from commencement to final resolution.

 

Duties:

  • Represent healthcare professionals, practices, facilities, and other healthcare entities in healthcare-related and commercial litigation matters.
  • Handle cases involving breach of contract, shareholder disputes, restrictive covenant violations, payor-related matters, medical staff-related disputes, licensure violations, insurance fraud, pharmaceutical company/distributor disputes, etc.
  • Apply knowledge of general commercial and healthcare law, Medicare and Medicaid reimbursement and compliance issues, managed care and health insurance regulatory matters, and pharmacy-related experience.
  • Counsel, investigate, defend, and litigate all forms of government inquiries.
  • Provide legal advice to clients regarding their rights and obligations under relevant laws and regulations.
  • Develop and execute legal strategies and take a lead role in proceedings.
  • Keep up to date with changes in relevant laws and regulations.
  • Provide thorough factual and legal research and analysis.
  • Review work-product by junior attorneys.
  • Identify legal and compliance issues, business risks, and offer effective solutions tailored to the situations.
  • Identify opportunities for department process improvements and efficiencies.
  • Communicate legal concepts and opinions in a digestible manner, with strong writing skills.
  • Build relationships, mentor junior attorneys, and influence both internal and external constituents.
  • Negotiate effectively with clients, opposing counsel, and the Court.
  • Demonstrate adaptability to reassess and adjust due to the evolving nature of the business.

 

Requirements:

  • Juris Doctorate degree from an accredited law school.
  • NJ Bar required; NY admission preferred, or must be obtained.
  • 8+ years of legal experience with demonstrated excellent working knowledge and primary focus in healthcare.
  • Strong preference for candidates with physician, healthcare facilities, or pharmacy experience.
  • Highly motivated with unquestionable integrity, ethics, and judgment.
  • Exceptional communication, relationship-building, mentorship, and influencing skills.
  • Exceptional negotiation skills and ability to communicate clearly and effectively.
  • Team player with a high level of self and cross-cultural awareness.
  • Highly intelligent with intellectual curiosity to understand complex business and legal issues and trends.
