This is a General Attorney position located within the Office of the General Counsel (OGC) in the New York Regional Office (Region II). Each regional office provides legal counsel and advice to all Departmental agencies with an emphasis on the advising agencies that have a presence in the given region. There are currently 9 attorneys and two support staff in Region II, and Region II’s jurisdiction includes New Jersey, New York, Puerto Rico and the Virgin Islands.

Attorneys in Region II provide advisory opinions and litigation support to the Department in complex matters requiring extensive research and sophisticated analysis of administrative law, judicial decisions, and statutory and regulatory law, often in cases of “first impression.” Region II attorneys represent the Department in administrative litigation before the Departmental Appeals Board and in collaboration with the Department of Justice in federal court litigation to enforce quality of care and other federal requirements and to aid in the recovery of misspent Medicare, Medicaid and federal grant funds. Region 2 attorneys also represent the Department in employment law cases before the Equal Employment Opportunity Commission and the Merit Systems Protection Board, provide legal advice to the Department regarding enforcement of the Federal civil rights statutes and HIPAA, and advise the Department in bankruptcy matters.

Candidates will be highly motivated industrious professionals with substantial experience independently managing portfolios of extremely complex and difficult legal questions or factual issues requiring the interpretation and application of constitutional, statutory and regulatory provisions; legislative and regulatory history; and administrative and federal court decisions to address novel, unsettled, and/or precedential high-profile matters that attract national scrutiny or have an important impact on major regulated entities, sectors, or public or private interests. Qualified candidates will also have strong academic credentials, significant experience in administrative or federal court litigation, demonstrated ability to work under competing deadlines, and superb writing, communication, and analytical skills. Significant regulatory and administrative law experience and familiarity with Medicare, Medicaid, and/or health insurance law is desirable.

Salary will be commensurate with education and experience. The following are required qualifications: You must possess a Juris Doctorate (J.D.) from an accredited ABA law school. Have at least four years of experience after law school as a practicing attorney. Proof that bar status is active, in good standing and eligible to practice in the highest court of a State, U. S. commonwealth, U. S. territory, or the District of Columbia.
