Florence County Government Logo FLORENCE COUNTY GOVERNMENT invites applications for the position of: Assistant Solicitor II (EAPP) SALARY: Depends on Qualifications FUND-DEPARTMENT: Solicitor DIVISION-SLOT: Assistant Solicitor II (EAPP) OPENING DATE: 02/01/22 DESCRIPTION: Under limited supervision, must be mentally and physically capable of prosecuting a wide variety of criminal cases in General Sessions Court and juvenile cases in Family Court. Appropriately manages court time as scheduled, and provides legal advice to County personnel and the public. Reports to Section Leader, if assigned to a Section, or Deputy Solicitor. Works at the pleasure of the Solicitor. EXAMPLES OF ESSENTIAL DUTIES: Reviews files and evaluates assigned criminal and juvenile cases. Conducts conferences with victims, witnesses, law enforcement personnel, public defenders, private attorneys, other solicitors, magistrates, probation and parole personnel, judges and defendants; performs legal research and prepares memorandum; reviews and prepares motions, orders and correspondence; evaluates crime scene investigations, etc. Prepares for court terms, including such duties as making victim, witness and law enforcement contacts; trial roster and plea list preparation and distribution; conducting prosecution team meetings and coordination of trials while cognizant of available court time; review and update of jail lists; identification and disposal of unassigned jail cases; review of cases and pre-trial negotiations. Attends and participates in criminal court trials, motion hearings, guilty pleas, in-chamber judicial conferences, jail transport requests and case negotiations. Performs miscellaneous administrative functions, including providing general legal advice and assistance, participating in law enforcement training, bond hearings on unassigned cases, etc. Attends meetings, conferences and seminars as necessary. Receives, reviews and evaluates various records and reports related to casework including incident reports, victim and witness statements, case file reports, warrants, discovery requests, affidavits, citations, NCIC reports, confessions, criminal histories, jail lists, trial rosters, dockets, juror lists, medical reports, autopsy reports, laboratory reports, fingerprint reports, SLED reports, court orders, hospital records, business records, bank records, photographs, etc. Prepares files and indictments, petitions, alibi requests, legal memoranda, affidavits, motions, plea agreements, subpoenas, court orders, requests for dismissal, witness lists, trial rosters, plea lists, photographs, exhibits, etc. Operates a variety of equipment such as a computer, printer, copier, audiovisual equipment, tape recorders, calculator, vehicle, telephone, etc. Interacts and communicates with Section Leader, Senior Assistant Solicitor, various groups and individuals, other staff members, County Council, law enforcement agencies, public defenders, private attorneys, defendants, witnesses, victims, court personnel, Judges, jurors, medical personnel, forensic experts, news media and the general public. ADDITIONAL JOB FUNCTIONS Recommends acceptance or rejection of cases for Diversion Programs such as: Pre-trial intervention program, Drug Court, DUI Court. Coordinates defendants’ competency evaluations at the State Hospital as necessary. Extradites criminals from other states. Performs related duties as required.
