This is a General Attorney position located within the Office of the General Counsel (OGC) in the New York Regional Office (Region II). Each regional office provides legal counsel and advice to all Departmental agencies with an emphasis on the advising agencies that have a presence in the given region. There are currently 9 attorneys and two support staff in Region II, and Region II’s jurisdiction includes New Jersey, New York, Puerto Rico and the Virgin Islands.

Attorneys in Region II provide advisory opinions and litigation support to the Department in complex matters requiring extensive research and sophisticated analysis of administrative law, judicial decisions, and statutory and regulatory law, often in cases of “first impression.” Region II attorneys

represent the Department in administrative litigation before the Departmental Appeals Board and collaborate with the Department of Justice in federal court litigation to enforce quality of care and other federal requirements and to aid in the recovery of misspent Medicare, Medicaid and federal grant funds. Attorneys also represent the Department in employment law cases before the Equal Employment Opportunity Commission and the Merit Systems Protection Board, provide legal advice to the Department regarding enforcement of the Federal civil rights statutes and HIPAA, and advise the Department in bankruptcy matters.

The selectee will be assigned a range of litigation and advisory matters involving Medicare financial and program integrity issues, nursing home quality of care compliance, physician and other provider/supplier enrollment determinations, employment and discrimination claims, Head Start financial and quality of care issues, HIPAA compliance, and bankruptcy cases.

We are seeking to fill the position at the GS-13 to GS-14 level ($115,118 – $136,035) depending on experience and qualifications. The position will be located in New York, New York.

Salary will be commensurate with education and experience. The following are required qualifications: You must possess a Juris Doctorate (J.D.) from an accredited ABA law school. Have at least two years of experience after law school as a practicing attorney. Proof that bar status is active, in good standing and eligible to practice in the highest court of a State, U. S. commonwealth, U. S. territory, or the District of Columbia.
