City Attorney
The candidate will be the chief legal representative for government and has managerial responsibility for providing comprehensive legal services to the municipality. Reports directly to the city manager. Responsibilities extend to providing contracted legal services to other public organizations, Great Falls Housing Authority. Directly supervises staff to include: Deputy City Attorney, Chief Prosecutor, Deputy Prosecutor, Prosecutor(s), Paralegal/Legal Assistant(s), Administrative Assistant, Legal Secretary(ies), Office and Administrative Specialist and other part-time staff members. Advises the Manager, Commission, Department heads and City employees on the implications and courses of action on a myriad of legal issues. Prepares formal written opinions on issues of significant concern for management where legal interpretation of a law is required. Drafts, reviews and revises contracts or written agreements, and supporting documents, in which the firm enters. Oversees and directs professional legal staff in the prosecution of misdemeanor violations in Municipal Court. Drafts legislation, inclusive of ordinances, resolutions and proposed statutes, for submittal to the Commission and state legislature for adoption. Handles risk management and litigation that involves labor law, contract claims, land use actions, civil rights, discrimination claims and negligence actions. Provides training to staff, boards, councils and commissions on topics regarding governmental processes and/or issues. Oversees financial aspects of the Legal Department, including payroll, invoices and budgeting. Responds and operates with assigned functions at the City Emergency Operations Center or at the site of a disaster any time of the day or night to properly manage the incident, and to keep the City government operational and functioning in support of the community’s needs during disasters or emergencies. Should have Graduation from an accredited college of law with an LLB or Juris Doctorate degree. Must have 8-10 years of practical, progressive experience as a licensed attorney. Should have 2-3 years of supervisory experience. Public sector experience preferred. License to practice law in the State of Montana is required. Maintains thorough knowledge of federal, state and local law relative to local government. Analyzes and interprets complex legal issues. Prepares, conducts or monitors effective litigation actions on behalf of the firm. Prepares and monitors Department budget and finances. Maintains extensive knowledge of rules of evidence, court procedures and practices. Maintains thorough knowledge of legal research methods and principles. Reviews the Official City Code of Great Falls and recommends updates/changes as appropriate after state legislative sessions or upon request of the City Commission and city manager. Maintains ability to work at the Emergency Operations Center in functional area of expertise and with the skills acquired through online (ICS 100, 200, 700, and 800) and in attendance (ICS 300) of incident command and National management Course work. Maintains proficiency in required skills for City-wide Emergency Operations. Assigns, directs and evaluates the work of subordinate staff. Communicates effectively, both orally and in writing.
