A law firm based in Sacramento, CA, is seeking a skilled Wage and Hour Attorney to handle wage and hour/FLSA labor and litigation representations. The ideal candidate will assist California employers in ensuring compliance with wage and hour laws and best management practices through audit services and preventative training. Additionally, the attorney will defend employers in complex wage and hour/FLSA class action and multi-plaintiff lawsuits, provide advice on FLSA legal issues, review payroll calculations, audit collective bargaining agreements, and litigate or advise litigators on FLSA issues.

 

Duties:

  • Handle wage and hour/FLSA labor and litigation representations.
  • Assist California employers in compliance with wage and hour laws and best management practices through audit services and preventative training.
  • Defend employers in complex wage and hour/FLSA class action and multi-plaintiff lawsuits through all stages of litigation.
  • Provide advice and counsel on FLSA legal issues.
  • Review payroll calculations for compliance with the regular rate of pay.
  • Audit collective bargaining agreements, personnel rules, and/or employee handbooks to identify wage and hour issues.
  • Litigate or advise litigators on wage and hour issues applicable to private employers.

 

Requirements:

  • Active license in good standing with the California State Bar.
  • 2-5 years of labor and employment experience.
  • Familiarity with California Labor Code sections and Wage Orders applicable to private employers.
  • Knowledge of the Fair Labor Standards Act (FLSA) and relevant Department of Labor regulations (29 CFR Parts 541, 553, 778, and 785).
  • Credentials from an ABA approved law school.

 

Education:

Juris Doctor (.) degree from an ABA-approved law school.

 

Certifications:

Active license in good standing with the California State Bar.

 

Skills:

  • Strong understanding of wage and hour laws and regulations.
  • Excellent litigation skills, including trial and appellate experience.
  • Ability to provide strategic advice to clients.
  • Exceptional research and writing abilities.
