A law firm in San Diego, CA, is seeking a Litigation Attorney to manage litigated matters, focusing on defensive litigation involving residential real estate, title to real property, mortgages, and foreclosure. The candidate will play a key role in handling contested litigation, advising clients on strategies, and ensuring compliance with all legal requirements.

 

Duties:

  • Manage all aspects of contested litigation related to mortgage servicing and/or foreclosure matters.
  • Handle pre-litigation cases and assist in clearing title to real property
  • Prepare case analyses and provide strategic advice to clients
  • Draft court pleadings and motions
  • Conduct discovery, including taking and defending depositions
  • Travel throughout the entire State of California as needed
  • Attend hearings, mediations, and settlement conferences and make court appearances
  • Utilize excellent written and oral advocacy skills in all aspects of civil litigation
  • Apply knowledge of the foreclosure process and requirements (preferred)
  • Manage and prioritize multiple projects and large caseload
  • Resolve problems quickly and efficiently
  • Adhere to the rules of evidence and introduce evidence effectively
  • Familiarity with consumer protection statutes, such as the Fair Debt Collection Practices Act (preferred)

 

Education and Certification:

  • Bachelor's Degree with a Juris Doctorate from an accredited law school
  • Member of the California State Bar, maintaining all necessary licensing and continuing legal education requirements

Skills:

  • Strong written and verbal communication skills
  • Proficiency with Excel and other Microsoft Office products
  • Excellent organizational skills
  • Ability to manage and prioritize multiple projects
  • Familiarity with rules of evidence and introducing evidence
  • Knowledge of consumer protection statutes (preferred)

 

Experience:

Minimum of 3-5 years of litigation experience in real estate or mortgage servicing (preferred)
