A law firm is seeking a qualified Traditional Labor Law Associate Attorney for their San Jose, CA office. The successful candidate will be responsible for handling various aspects of traditional labor law and providing legal advice to employers on labor relations, workplace issues, and compliance matters.

Job Overview:

The Traditional Labor Law Associate Attorney will play a key role in representing management in NLRB elections, negotiating collective bargaining agreements, and advising employers on various labor-related issues. The candidate will be involved in research, writing, and providing legal counsel to ensure compliance with federal and California labor laws.

Duties and Responsibilities:

  • Handle unfair labor practice charges at the National Labor Relations Board (NLRB).
  • Represent management in NLRB elections.
  • Provide legal advice to employers on union organizing, corporate campaigns, card checks, and neutrality agreements.
  • Negotiate and/or provide legal advice regarding collective bargaining agreements.
  • Handle grievance, arbitration, and unfair labor practice proceedings.
  • Obtain mass picketing injunctions.
  • Advise employers on federal and California wage and hour issues, leave management, disability accommodating issues, and other workplace matters.
  • Review handbooks, policies, and forms for compliance with federal and state law.
  • Review compensation, commission, and bonus plans.
  • Conduct management training on labor relations, federal and California workplace issues, harassment, discrimination, and retaliation.
  • Perform other duties and responsibilities as reasonably assigned.

Requirements:

  • JD from an ABA-accredited law school.
  • 4-6 years of experience in litigation or advice work as an attorney.
  • Traditional labor law experience preferred.
  • Experience in federal and/or California advice and counsel work preferred.
  • CA Bar Admission.
  • Understanding of current agency (state and federal) enforcement techniques is preferred.

Skills:

  • Excellent attention to detail.
  • Strong organizational and project management skills.
  • Excellent written and oral communication skills.
  • Bilingual proficiency in English and Spanish is preferred.

Education:

  • JD from an ABA-accredited law school.

Certifications:

  • CA Bar Admission.
