Job Overview:

A law firm seeks a Trust Litigation Attorney to join its team in Tustin, CA. The ideal candidate will have at least 3 years of experience handling Probate, Trust Litigation, and Conservatorship matters. The Trust Litigation Attorney will be responsible for guiding clients through various legal processes, conducting legal research, drafting legal documents, and representing clients in court. The role requires strong communication skills, attention to detail, and the ability to work independently and collaboratively.

Job Duties:

  • Ability to work independently and delegate tasks to paralegals and staff.
  • Assist with Probate, Estate Planning, Conservatorship, and Trust Administration.
  • Work closely with firm members and clients through written communication, in-person meetings, and telephone conversations.
  • Interview prospective clients, provide legal advice, and prepare legal documents.
  • Develop and manage a caseload, guiding clients through probate, trust, conservatorship administration and litigation matters.
  • Conduct legal research, analyze cases, and develop legal strategies.
  • Draft various legal documents, including discovery, client letters, opinion letters, demand letters, settlement proposals, petitions, declarations, motions, and settlement and trial briefs.
  • Attend and conduct depositions, propound and respond to discovery requests, and subpoena records from third parties and witnesses.
  • Summarize discovery and make court appearances.
  • Prepare Law and Motion Court Filings.
  • Engage in legal research and analysis using Westlaw/Lexis.
  • Participate in settlement conferences, advising clients on case strengths and weaknesses.
  • Track and bill time spent on legal tasks.
  • Maintain strong computer skills, with a minimum typing speed of 45wpm.
  • Bilingual Spanish/English proficiency is preferred.
  • Communicate clearly and respectfully with individuals facing educational, language, cognitive impairments, or other barriers to understanding.
  • Demonstrate a willingness to learn and continue practicing in the field of law.
  • Knowledge of and preparation of fiduciary accountings is a plus.

Job Requirements:

  • Minimum of 3 years of experience handling Probate, Trust Litigation, and Conservatorship matters.
  • Additional experience in Civil Litigation and Financial Elder Abuse is a plus.
  • Licensed to practice law in the State of California.
  • Trial Experience and/or deposition experience is a plus.
  • Bilingual Spanish/English proficiency is preferred.
  • Ability to communicate clearly and respectfully with diverse clients.
  • Strong computer skills with a minimum typing speed of 45wpm.
  • Notary Public certification is a plus.
  • Ability to work independently and proactively manage court and client deadlines.

Education and Certifications:

  • Juris Doctor (.) degree from an accredited law school.
  • Admission to the State Bar of California.
