About Sam and his team represent insurers, insurance brokers and claim administrators in a wide range of commercial litigation matters arising out of large loss-sensitive insurance programs and guaranteed cost policies across all lines of insurance; errors & omissions across underwriting, coverage, claims handling and brokerage services; insurance coverage counseling and litigation; and complex claim defense. Sam understands both the business and legal aspects of national accounts, commercial insurance, and recurring issues raised by policyholders. His capabilities span every aspect of the insurance practice, such as retrospective premium formulas and calculations, large deductible formulas and calculations, allocated loss adjustment expense billing methods, coverage counseling and litigation, guarantee cost policies, premium audits, premium credits, dividends, claims handling and reserving, bad faith, experience modification factors and the impact on such factors from claims mismanagement, collateral draws and deficiencies, environmental and mass tort claim allocations across triggered policies, cost-share agreements and contribution claims, premium financing arrangements, broker and agency relationships, and reinsurance. Sam regularly gives presentations to clients and trade associations regarding substantive law and effective litigation strategies. Sam also served as the expert witness for the prevailing party in a multimillion-dollar arbitration which centered on the parties’ strategies, decisions and actions in a commercial litigation matter involving a large retrospectively rated insurance program with allegations of pervasive claims mismanagement. For almost three decades, Sam has also practiced workers’ compensation law on behalf of employers. This practice is focused on the representation of self-insured employers and those with substantial risk retention in workers’ compensation matters and intentional wrong civil actions. This allows a thorough understanding of our clients’ businesses, personnel and operations, which we believe is critical to effective defense work. Sam’s workers’ compensation practice also makes him uniquely qualified to defend insurers and claim administrators in bad faith lawsuits and counterclaims involving allegations of claims mismanagement.
