Associate Claim Attorney The candidate investigates and resolves claims made against a variety of surety bonds. Reviews and evaluates coverage and/or liability. Assigns cases to outside counsel and evaluates counsel’s performance. Develops, prepares and implements Claims Litigation strategy, moving cases toward settlement where appropriate and recommending reserves within prescribed limits. Works toward the resolution of claims files and attends arbitrations, mediations or trials as necessary, but not as attorney of record. Provides legal advice and counsel to Claims and Underwriting staffs. Ensures compliance of claims handling pursuant to all state, legal, statutory and regulatory bodies. May provide oversight and supervision to outside counsel on claims-related litigation. May provide guidance and assistance to lower level positions. Attends all matters of claims-related meetings as appropriate. Works with divisional management on drafting agreements. Reviews bond forms, contracts, agreements and other documents as required. Determines available avenues of loss recovery and their cost-effectiveness; coordinates approved recovery efforts. Conducts online research to obtain public access on case and docket information, court filings, and other legal documentation using multiple online sources and data. Must be open to travel up to 10% of the time, including some overnight travel as needed. Should have JD degree from an accredited law school and 3-5 years of related experience. Construction, probate and/or fiduciary law experience is a plus. Strong negotiation and mediation skills are required. Strong verbal and written communication skills are necessary for this position. Must be proficient in MS Office and possess the skills necessary to conduct research using LexisNexsis, Assurant, Public Access to Court Electronic Records (PACER), etc.
