Vice President, Intellectual Property The candidate will develop and retain a world-class patent and trademark prosecution and litigation team of up to 50 members focused on protecting new inventions and marketed products throughout the world. Will advise senior management and the Board of Directors on IP strategies, including what can and should be protected, where patents should be filed, risks and opportunities associated with business development transactions, and generic entry of Gilead products. Formulate and implement policy for US and foreign patent and trademark applications and patent term extension applications on a global basis. Evaluate and address third party IP rights and advise senior management on the implications of such rights, including evaluating the validity of competitor patents. Manage pre-patent filing review, providing legal advice to the company concerning the patentability of its inventions and the advisability of filing patent applications covering the company’s inventions in various locations throughout the world. Manage pre-litigation filing review, providing pragmatic legal advice to senior management concerning strengths, weaknesses, risks and options, on a global basis. Advise research, development, and commercial project teams on IP matters. Supervise all IP litigation, foreign oppositions and other contested matters. Demonstrated successful track record in building and leading a complex, international Intellectual Property department focused on prosecution and high-stakes IP litigation is needed. Exceptional management skills to attract, develop, and retain highly skilled IP prosecutors and litigators. Record of managing continuous improvement of processes and procedures throughout the department is essential. Exceptional presentation and communication skills; accustomed to working with C-Level management and interfacing with the Board of Directors is essential. An advanced degree in chemistry or closely related field, and a JD degree from a nationally recognized law school is needed. Should have 15+ years of prior industry and law firm experience managing both increasingly complex prosecution and litigation matters for diverse intellectual property portfolios. Must have demonstrated authoritative and influencing skills, depth, and expertise in area of responsibility. Excellent presentation and communication skills are needed.
