Wage & Hour and Employment Practices Staff Attorney The candidate will ensure employer compliance with Vermont minimum wage law, payment of wages, state prevailing wage laws, state child labor laws, state leave and benefit laws (including the new earned sick time law) and other employment laws over which the Department of Labor may have jurisdiction. Duties involve establishing and implementing program goals; preparing and updating complaints, investigations, enforcement, and compliance, including investigating and resolving complaints and imposing sanctions as appropriate. Will negotiate settlements on behalf of complainants, and conduct follow-up monitoring as necessary. Regularly present and defend determinations of the wage and hour unit, including in superior court. Unpaid determinations will require collection activity in small claims and superior court. Pursue civil court action in certain cases as directed by the General Counsel. Should have extensive interaction with employers to provide outreach, education, and training. Work collaboratively with unemployment insurance auditors and workers’ compensation investigators in support of their duties. Provide training to department staff and may supervise. Reports to the General Counsel of the department and will assist the General Counsel with additional legal work as needed. Duties are performed statewide and require considerable public and employer contact. Admission to the Vermont Bar is required. Deadline: 16, March 2018.
