ProfileAttorney V Duties : Performs complex professional legal work concerning the compliance with and the interpretation of federal and state laws, rules and regulations for the Department. Work requires contact with governmental agencies and private entities. Assigns the work of others. Works under minimal supervision, with considerable latitude for the use of initiative and independent judgment. Advises Department on broad range of legal issues and interprets laws, rules, regulations, case law, opinions, decisions and court orders. Researches legal issues and provides analysis in both written and verbal form. Drafts, negotiates and reviews contracts; advises Department regarding procurement laws, rules and guidelines. Assists with drafting agenda items for board meetings and advises on Open Meetings Act issues. Drafts administrative rules and prepares documents for filing with the Secretary of State. Advises on legal aspects of personnel issues, conflicts of interest, ethics, complaints and grievances. Provides legal advice regarding responses to inquiries, subpoenas, orders and requests for documents. Advises and collaborates with agency staff outside of the Office of General Counsel. Works with attorneys from the Office of the Attorney General (OAG) (or other attorneys representing the Department) to prepare for hearings, trials, appeals, mediations and all aspects of pre-trial discovery in cases involving the Department. Attends hearings, trials and mediations to support OAG attorneys or other attorneys representing the Department. Formulates and recommends rules and policies. Assigns the work of paralegal, technical and clerical employees. Analyzes proposed legislation, drafts bill analyses and drafts amendments to or substitutes for pending legislation upon request. Researches, frames issues and prepares formal requests to the Attorney General for written opinion or decision. Performs other job-related duties as assigned.
Qualification and Experience
Qualification : The candidate should have Juris Doctorate degree from an accredited law school plus 7+ years professional legal experience with an emphasis in governmental or administrative law. Experience in an office of general counsel or equivalent is preferred. Must be licensed to practice law in the State of Texas and must be a member in good standing of the State Bar of Texas. (Experience requirements may be satisfied by full-time experience or the prorated part-time equivalent.).
