Attorney I The candidate will analyze and interpret state statutes and regulations and to draft proposed legislation for Labor Department. Provides official opinions on statutes and regulations. Monitors proposed legislation to ascertain impact on Labor Laws; provides testimony before the legislature on proposed legislation that affects Departmental regulation or operation. Conducts legal research concerning current or prospective policies and procedures; interprets ramifications of court decisions upon Departmental regulation or operation, reviews legislative intent for policy making. Develops policy with management staff to implement new legislation. Assists Departmental staff through the administrative rulemaking process for Workers' Compensation, Wage and Hour, Managed care, Self-Insurance and any new legislation that requires new regulations. Provides training to Department staff and members of the Compensation Appeals Board in areas of sexual harassment, safety measures and decision writing. Represents the Department in court and/or administrative proceedings and pursues legal collection efforts for unpaid civil penalties. Coordinates and prepares Departmental responses to requests for information under state law. Responds to Legislature for additional research and reports; performs polling of other state laws.
Qualification and Experience
The candidate must have JD degree from a recognized law school. Should have 2+ years' experience in the practice of law. Must be an active member of the New Hampshire Bar Association and in Good Standing. Knowledge of pertinent laws of trial, legal procedures, and methods of legal research is required. Ability to prepare legal cases and briefs and to represent an agency in court proceedings is needed.
