ProfileAttorney III The candidate performs moderately complex attorney work as part of the litigation team in the Office of Chief Counsel. Job includes: interpreting state and federal laws and rules related to programs administered by the agency, drafting documents, rendering legal advice and counsel to agency management and program staff, working with the Office of Attorney General (OAG) to defend and prosecute lawsuits involving the agency, assisting in the preparation of cases for trial and hearings, and other duties as assigned. Works under the supervision of more senior attorneys with latitude for the use of initiative and independent judgment. Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties as assigned. Drafts summaries of new litigation identifying parties and claims, and works with more senior attorneys to identify defenses and evaluate potential risks to the agency and its employees. Drafts timely, accurate, and concise updates for the Director of Litigation and Chief Counsel concerning the status of, and new developments in, agency lawsuits. Researches legal issues related to litigation and provide timely, accurate, and concise analysis and advice. Drafts letters to the OAG requesting representation in litigation. Works with the assigned Assistant Attorney General (AAG) and agency staff to respond to complaints and petitions. Researches claims and defenses and, in consultation with more senior attorneys, ensure appropriate motions are filed timely by the OAG. Drafts and reviews briefs and motions as needed. Reviews discovery requests and work with agency staff to identify responsive information and documents. Drafts or reviews discovery responses and objections. Uses e-discovery software to review documents and other information for production. Drafts or reviews discovery requests as needed. Ensures the OAG pursues offensive discovery as needed. In consultation with more senior attorneys, draft recommendations for review by the Director of Litigation and Chief Counsel on whether to appeal court rulings. Drafts or reviews appellate briefs and arguments and works with OAG to ensure appeals are filed timely. Review settlement recommendations from OAG and, in consultation with more senior attorneys, drafts settlement recommendations for review by the Director of Litigation and Chief Counsel. Participates in settlement negotiations and ensure that all settlement documents adequately protect the agency's interests. Works with OAG and agency staff to ensure appropriate implementation of settlements. Graduation from an accredited law school with an LL.B. or a J.D. degree is required. Must have 2+ years of litigation experience and be licensed as an attorney by the State of Texas and a member in good standing with the State Bar of Texas. Should have knowledge of the federal and state rules of civil evidence and procedure. Skills in researching, reviewing, analyzing, interpreting and applying federal and state laws, rules, and other regulations affecting the agency essential. Application Deadline: March 19, 2018.
