The Fresh Air Fund is recruiting an Attorney to oversee the organization’s legal needs. 

The Fresh Air Fund is seeking an attorney with 4-8 years of experience to oversee the legal aspects of FAF’s organizational work to ensure that the Fresh Air Fund can best support the children and families it serves across New York City.  The complexity, scope and diversity of FAF’s legal needs cover a wide range of legal issues including human resource management, employee matters, managing insurance policies, overseeing the enterprise risk work, reviewing contracts, bequests and planned giving management, and environmental needs affecting its real estate portfolio in the lower Hudson Valley.  The position requires an attorney who has a working knowledge of the legal rules that apply to nonprofit organizations but who is also a generalist or has the capacity to develop into a skilled generalist.  The ideal candidate will be customer-service oriented and able to offer legal counsel across departments and collaborate with others to devise and implement creative legal solutions in a complex nonprofit setting.

Reporting to the Executive Director and working closely with members of the Senior Staff, the Attorney will serve as a member of the Fund’s Leadership Team and will represent the FAF in all legal matters, and work with outside counsel as identified or needed, and provide counsel to the ED, staff, and Board of Directors when necessary. 


  • Support and protect the Fresh Air Fund’s mission with legal support and guidance.
  • Ensure FAF operates within the appropriate legal governance framework and responsibility for the identification and management of legal risks across FAF.
  • Provide a full range of legal guidance and needs including but not limited to: human resources, child welfare and well-being, governance; compliance; labor and employment; real estate; information protection; contracts and procurement; environmental rules; risk management matters; and trusts and estates.

More specifically,

  • Review, negotiate and draft a variety of contracts and other agreements, and oversee the contract management function, including ensuring that contract processes are up-to-date and effective.
  • Stay up-to-date with and advise staff on laws applicable to volunteer engagement, employment matters, child well-being, public health and education policy.
  • Serve as a broad-based resource for staff legal concerns and collaborate to find practical answers to a diverse range of legal questions associated with FAF’s work and operations, including serving as lead investigator for FAF on legal matters.
  • With the assistance of outside guidance and under the direction of the ED and CFO, maintain the organization’s employee handbook, prepare offer letters, conduct exit interviews, lead internal investigations, and provide advice on human resource matters.
  • Create staff-friendly policies, procedures and systems around a variety of legal compliance issues.
  • Support CFO on managing the reporting and other compliance requirements for the organization’s insurance profile and needs.
  • Assist in developing, presenting, and training on legal issues.
  • Strategically consult with and help effectively manage the organization’s outside counsel
  • Collaborate with other teams on organization-wide projects
  • Other duties and projects as assigned

Requirements / Qualifications

  • Graduate of accredited law school and member of the New York State Bar
  • Minimum of 4-8 years of experience in one or more of the following settings: in-house or of counsel in nonprofit, foundation or university or practice in a firm, or a combination of years of experience in legal practice.
  • Sophisticated ability to understand and manage risk and compliance issues.
  • Superb analytical, research, writing, advocacy, and problem-solving skills.
  • Exceptional interpersonal and communication skills-including listening, cooperating, and supporting colleagues in their strategic objectives;
  • Legal and ethical stature, maturity, flexibility, competence and confidence to operate with credibility at the executive and Board level, as well as a professional history of maintaining objectivity while driving appropriate outcomes, managing multiple stakeholder agendas, and promoting high client service standards.
  • Confidence to make difficult decisions given competing priorities and expectations and prevent larger legal problems in the future.
  • Intellectual flexibility and creativity, with the ability to analyze, interpret, present, and write about complex ideas and concepts in a clear, concise fashion.
  • High level of energy, sense of humor, and grace under pressure; and the ability to lead by example.
  • Appreciation for Fresh Air Fund’s mission and commitment to children and families in New York City.
