Legal Counsel

DUTIES: Understands and directly answers complex legal questions. Serves as a resource for legal matters involving Medicaid, Medicare and Dual-Eligible behavioral health programs including Medicaid Waiver matters. Serves as a resource for the interpretation and application of the Michigan Mental Health Code including matters involving recipient’s rights. Responsible for review and/or drafting of direct service provider, sub-recipient, professional services, and independent contractor agreements, as directed. Serves as a resource for Federal, State, and Local legislative and regulatory related matters and may directly interact with state and federal agencies, including contract negations with the aforementioned parties. Analyze legislative and regulatory requirements and assist business units in their implementation. Interaction with all levels of Authority personnel to obtain information and provides counsel regarding sensitive and complex legal issues. Manages complex projects and coordinates work assignments with the legal staff, to deliver timely results, as directed. Serves as a resource for management throughout the organization with respect to legal issues or concerns as they arise, including issues related to member services. Supports all aspects of PIHP and CMHSP operations, which may include provider contracting, provider disputes, provider and member appeals, claim investigations, or employer group contract issues. Serves as a resource for management throughout the organization and the provider network with respect to federal and state privacy laws and regulations, including HIPAA, business associates agreements and breach notification obligations.

Qualification and Experience

Qualifications: Knowledge of fundamental law, research procedures, preparation of pretrial briefs and arguments and trial of complex cases. Ability to speak, write and present arguments and ideas clearly and effectively. Ability to use judgment, tact and discretion. Ability to provide and assist in providing wide range of legal services. Ability to assimilate data, analyze facts and draw logical conclusions. Ability to provide and assist in providing wide range of legal services. Knowledge of litigation and corporate transaction practices. Ability to identify potential legal issues. Strong interpersonal, writing and verbal communications skills. Strong organizational skills and the ability to work under pressure, meet deadlines, and able to work independently and as a part of a team to prioritize responsibilities, take initiative and self-motivate/self-manage work and time. Openness to the emerging workforce in community mental health, including people with lived experience, their family members, allies and fictive kin. Healthy respect for the needs and interest of the individuals who receive services. Knowledge of, or have had personal experience with behavioral health issues is desired. DESIRED EXPERIENCE AND TRAINING: Graduation from an accredited law school. Admission to practice before the Michigan Supreme Court and active membership in the State Bar of Michigan. 5+ years’ experience with a law firm and/or in-house position providing legal services for sophisticated/complex health care and corporate transactions.
