Director, Strategic Coverage Counsel – Environmental and Mass Tort Claim/Asbestos, Life Science, Construction Defect- The candidate will accept referrals of complex coverage matters and other claim-related legal issues from company’s Commercial Claim organization, primarily from the Environmental and Mass Tort Claim/Asbestos, Life Sciences, and Construction Defect disciplines. In this role, may also provide assistance from time to time in other lines of business. As a member of our commercial claim legal team, you will perform legal research and analysis of complex coverage issues and provide counsel, guidance, recommendations, and periodic support for training initiatives and other special projects. Work assignments include providing legal advice and litigation support in connection with the most complex and/or severe claims and related coverage issues. Performs a combination of duties in accordance with departmental guidelines: Provides legal and strategic analysis and advice to claim teams and other internal business partners with respect to complex coverage issues and the potential impact of coverage on overall claim exposure and legal risks by researching and analyzing issues in both litigated and non-litigated matters. Partners with claim professionals in developing and executing strategies for handling claim related legal issues that range from simple low impact to complex multi-faceted and high impact. Manages and oversees coverage litigation and serves as the decision point for engaging external counsel, including selecting and working with counsel and assisting with the preparation and editing of briefs and other substantive filings and communications. Develops written and verbal communications regarding coverage with our customers, their counsel, claimants’ counsel, and others. Develops and drives execution of negotiation strategies for coverage matters. Facilitates claim resolution by engaging directly with customers, claimants, and other insurers through mediations, settlement conferences, and other forms of alternative dispute resolution. Partners with Claim Underwriting and Product Development teams to develop, supplement, and revise policy language. May participate with Senior Management in the development and implementation of claims and business policies. Maintains big-picture perspective while identifying and executing critical strategies and priorities for complex claim-related legal issues. Educates key stakeholders by providing ongoing formal and informal coverage training to our claim teams and other internal business partners. Tracks legal and regulatory changes and advises claim teams and other business partners of the impact of such changes. May perform additional duties as assigned. Reporting Relationship: Typically AVP and above.
Qualification and Experience
The candidate should have Bachelor's degree with JD and admission to the Bar of at least one state. Typically requires 10 years of coverage experience with a law firm and/or insurance carrier with progression in responsibility. May require specific technical/functional area legal experience. Should have senior level knowledge of the law, as well as legal theories, principles, and litigation practices and procedures within an insurance organization. Must have excellent technical and product specific expertise of commercial insurance products. should have 8-10 years of experience, either in an in-house position handling claims of the highest severity, or in a law firm providing legal advice and litigating third-party insurance claims of the highest severity and complexity, and will possess top-tier legal research and communication skills and coverage acumen. Ideal candidates will also have prior experience as a third-party coverage attorney, be admitted to the bar of at least one state, and have substantial experience providing in-house legal support and strategic counsel to claims staff and senior management in connection with third-party lines of business (principally Environmental and Mass Tort/Asbestos, Life Sciences, and Construction Defect). Should have ability to work collaboratively with others to achieve desired results, including helping self and others to excel through building strong relationships. Must have excellent verbal and written communication, negotiation, and presentation skills and the ability to effectively interact with all internal and external business partners. Must have ability to exercise independent judgment and to work with and maintain confidential and sensitive information. Should have excellent analytic and creative problem solving skills, along with senior level skill in managing and resolving highly complex claim-related situations and issues. Must have knowledge of Microsoft Office Suite and other business-related software (including Adobe and Westlaw).
