ProfileAssistant Attorney General The candidate will represent the state in Capital collateral litigation prosecuting first degree murder cases where the death penalty has been imposed. Position entails serving as either lead counsel or co-counsel in the state circuit and Florida Supreme Court, as well as, representing the state in habeas actions in federal district, circuit and United States Supreme Court. Litigation includes attendance at evidentiary hearings at all post-conviction and appellate stages, research, preparation of briefs, responses, motions and other functions directly related to appeals (capital direct appeals, interlocutory actions, collateral appeals, and extra-ordinary writs). Handles emergency circumstances (pleadings preparation and court appearances) in all levels of state and federal courts, including during the pendency of an active death warrant. Keeping current of all state and federal decisions directly or indirectly impacting on capital cases. This includes becoming familiar with all capital cases in the office, and maintaining a communications network with other capital specialists in other offices. Provides advice and assistance to other attorneys with legal analysis, brief preparation and other attending responsibilities.
Qualification and Experience
The candidate must have admission to the Florida Bar and 3+ years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided membership in the Florida Bar is attained within 12 months of appointment to a position in this class is needed. Extensive comprehension of criminal law, constitutional law and federal habeas corpus practice is preferred. Trial and/or appellate experience and an ability to handle time constraints; complex legal analysis and multifaceted litigation are minimal requirements is a plus.
