Corporate Counsel, US Market Access The candidate will reports to the Associate General Counsel and is a key member of the team for the Legal & Compliance Department. Will provide legal advice and support to the commercial market access function, which is responsible for government payments and reimbursement, commercial payer interactions, pharmacy services, product pricing, government price reporting, and trade and distribution. Support the contract needs of the market access function, including commercial payer, Medicare Part D, government contracts, and trade/distribution contracts. Provides legal advice and counseling in the areas of U.S. healthcare law, including FDA regulations and anti-kickback, government price reporting, fraud and abuse, anti-bribery, and product liability statutes and regulations. Serves as strategic business partner to executive management and commercial leadership team on market access, pricing and reimbursement, pharmacy services and trade and distribution matters. Supports Jazz managed markets team with advice about, and assists in drafting and negotiating contracts for, commercial relationships, Medicare Part D, government contracts, managed care, and trade/distribution issues. Provides advice and guidance on issues pertaining to best price, AMP, ASP, and government price reporting. Serves as a subject matter expert in areas of healthcare regulatory law, including rules and regulations of the FDA, OIG, CMS, and applicable anti-kickback, fraud and abuse, anti-bribery, and product liability statutes and regulations. Provides advice on market access initiatives and patient assistance programs. Serves as the legal representative on promotional materials review committee and provides legal review of training materials, corporate communications, etc. related to market access topics. Participates as the legal representative on other corporate, commercial and medical affairs committees on an as-needed basis. Stays abreast of and communicates to the organization significant legal developments, legislation and regulatory rulings that may affect the company in the area of U.S. commercial healthcare law, particularly with respect to market access issues. Establishes a strong rapport and a positive working relationship with colleagues at all levels, particularly within the home office and field-based market access organization. Assists with supporting corporate compliance function; helps create and deliver policies, procedures and training to stakeholders. Drives increased efficiency, coordination, and effectiveness of legal advice, processes, and support to meet the needs of the market access function and other key stakeholders. Partners with Legal & Compliance Department colleagues in executing and enhancing corporate and department objectives. Supervises outside counsel as required.

Qualification and Experience

The candidate should have Juris Doctorate (J.D.) degree and admission to the Bar of at least one State and eligible to practice as in-house counsel in California or Pennsylvania. Must have 5-7 years' of experience with a life sciences company and/or a reputable, highly rated law firm, or a combination of both, with a substantial amount of professional experience dedicated to advising clients on legal and regulatory issues relating to market access and managed care contracting. Demonstrated broad understanding of pharmaceutical industry and regulatory enforcement environment including familiarity with regulations and regulatory guidance by the U.S. Food & Drug Administration is required. Demonstrated experience working in a matrixed business environment, managing multiple commitments while prioritizing conflicting demands, maintaining focus on corporate objectives and providing quality customer service is required. Demonstrated experience identifying and resolving legal and compliance issues quickly and effectively is required. Excellent verbal and written communication skills needed.
