Labor and Discipline Counsel The candidate will serve as a Labor and Discipline Counsel reporting to the Human Resources division. In partnership with the Senior Labor Relations Analyst, coordinate the agency's Labor Relations, Employee Discipline, and Employee Health and Safety programs. Will serve as a Labor and Discipline Counsel reporting to Human Resources. Responsibilities will include: Promote the agency's best interest while maintaining cooperative labor relations in compliance with collective bargaining agreements, civil service law, and City rules and regulations; prepare and issue disciplinary charges and specifications on referrals; oversee the implementation of terminations and disciplinary penalties; coordinate occupational safety and health initiatives as mandated by regulations, contractual agreements, and law; administer agency grievance review and serve as Step II agency review officer; serve as agency counsel at Step III hearings at the Office of Labor Relations and at arbitration proceedings at the NYC Office of Collective Bargaining; attend collective bargaining information sessions as the agency representative; coordinate with the Assistant Commissioner for Human Resources to advise all levels of management on the handling of labor issues and contractual obligations; negotiate and mediate grievance and disciplinary settlements and stipulations; liaise with Union representatives and coordinate and participate in all labor-management meetings as requested by union or management; manage employee relations programs and related special projects.
Qualification and Experience
The candidate must have admission to the New York State Bar; and either "2" or "3" below. Should have 1+ year of satisfactory United States legal experience subsequent to admission to any state bar; or 6+ months of satisfactory service as an Agency Attorney Interne (30086). Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment. Should have 1+ year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the Bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. 5+ years of demonstrated full-time professional employee discipline or labor relations experience in NYC government is preferred. Extensive knowledge of collective bargaining provisions, the Citywide Agreement, unit agreements, civil service laws, OSHA regulations, and DCAS rules and regulations is desired. Experience negotiating settlements is a plus. Experience delivering training on labor relations, employee discipline, and/or employee health and safety is helpful.
