In House Counsel The candidate will be responsible for interpreting and advising on laws and regulations that impact credit and collections. Review contracts prior to funding to ensure compliance and accuracy and that they will be acceptable in court should the need to litigate arise. Assess likelihood of recovery on defaulted accounts; file confessions of judgment. Analyze assets/property subject to enforcement of the judgment by levy, garnishment and other lawful judicial remedies. Conduct judgment debtor examinations; file proof of claims in bankruptcy cases. Manage projects and initiatives that help identify and mitigate legal risk. Advise management, finance, human resources, and other company departments on legal issues and risks, procedures and negotiation strategies, and complex contracts and deal structures. Support the continuous improvement of standard form agreements and legal processes. Manage legal aspects of policies, procedures and processes. Act as liaison for company and Commercial Finance Coalition; participate in regulation meetings and advise management of industry recommendations.
Qualification and Experience
The candidate should be a knowledgeable attorney or Juris Doctor degree from an accredited US law school and licensed to practice law in the State of New York (required). Must be experienced in credit and collections. Experience in legal/compliance related issues, preferably in financial services is essential. Experience drafting, reviewing and amending contracts entered into with clients and vendors is essential.
