The candidate will advise management concerning legal rights, statutes, regulatory and compliance matters. Will interpret laws, rulings, and regulations for the company. Examine legal data to determine advisability of defending or prosecuting lawsuit. Act as agent of corporation in various transactions. Represent the company in litigation and other legal proceedings. Advise management concerning transactions of business involving internal affairs, directors, officers, stakeholders and business relations with general public. Study statutes, decisions, and ordinances of quasi-judicial bodies. Responsible for contract preparation and review. Prepare and file government reports. Draft legal documents. Review new business relationships with vendors and subcontractors. Administer training workshops. Create and review company forms and documents. Analyze legal issues relating to proposed products. Represent the company before administrative boards and court trials. Provide supervision to outside lawyers hired to assist the corporation with their specialized legal services. Handle all company insurance policies. Purchase, compare, assess coverage, final contact review, etc. Structure joint enterprises with other organizations. Support employee relations, talent acquisition, compensation, benefits, workers compensation, and policy alignment and compliance. Serve as catalyst in driving culture of continuous improvement by being service oriented, project management, and deploying best practices across the company to improve cost, quality, and employee engagement. Maintain and update job requirements and job descriptions for all positions. Maintain organization staff by establishing a recruiting, testing, and interviewing program; counsel managers on candidate selection; conduct and analyze exit interviews; and recommend changes. Organize and supervise Workers Compensation Program and process legal documents. Develop and ensure compliance to compensation policies and procedures. Manage employee injury cases and oversee all investigation claims for various parties. Participate in all worker compensation hearings. Analyze inquiries and complaints and assisted in resolving all complaints. Maintain records for all worker compensation claims and related activities. Maintain a pay plan by conducting periodic pay surveys; scheduling and conducting job evaluations; preparing pay budgets; monitoring and scheduling individual pay actions; and recommending, planning, and implementing pay structure revisions. Ensure planning, monitoring, and appraisal of employee work results by training managers to coach and discipline employees; scheduling management conferences with employees; hearing and resolving employee grievances; and counseling employees and supervisors. Maintain employee benefits programs by assessing benefit needs and trends; recommending benefit programs to management; plan design; obtaining and evaluating benefit contract bids; and awarding benefit contracts. Ensure legal compliance by monitoring and implementing applicable human resource federal and state requirements; conducting investigations; maintaining records; and representing the organization at hearings. Maintain management guidelines by preparing, updating, and recommending human resource policies and procedures. Maintain and audit human resource records by designing a filing and retrieval system; and keep past and current records. Maintain professional and technical knowledge by attending educational workshops; reviewing professional publications; establishing personal networks; and participating in professional societies. Maintain human resource staff by recruiting, selecting, orienting, and training employees. Maintain human resource staff job results by counseling and disciplining employees; and planning, monitoring, and appraising job results. On-board new staff. Maintain required documentation in employee personnel files. Act as advisory resource and provide legal consult to HR on employee relations matters and cases. Collaborate with HR on strategic employee relations plans and approach. Work with HR on policy updates and provide State and Federal legal updates regularly to HR to ensure compliance. Coordinate employee relations litigations cases and act as liaison between HR, external litigation firm, and claimant. Review and provide consult on employee relations corrective action documentation and employee communications material. Work with and consult HR and external immigration law firm on any immigration issues. Assist in reviewing and updating personnel policies and procedures in accordance to Federal and State requirements as well as current and future labor laws. Bachelor's degree or MBA is required. Must have J.D. degree from an accredited law school and be admitted to the State Bar. Should have familiarity with federal court practice, as well as with the Equal Employment Opportunity Commission, Department of Labor, and other federal, state and local government administrative agencies. Should also have some litigation experience, including drafting responsive pleadings, handling all aspects of the discovery process, and drafting motions, including motions for summary judgment. Must be familiar / have experience with FMLA / Leave Compliance, HIPPA; Employee Handbooks, Harassment / Discriminations prevention, etc.
