Associate Senior Counsel - Fraud, Waste, and Abuse/Part D
The candidate will provide legal and regulatory advice to company's US healthcare and government teams with respect to Medicare fraud, waste and abuse laws and regulations, state and federal anti-kickback and self-referral prohibitions, and the administration of Medicare Part D health plan business. Will provide counsel on the design and/or administration of Medicare Part D prescription drug plans based on applicable laws, regulations and guidance. Provide counsel on matters involving or potentially involving Medicare fraud, waste and abuse and state and federal anti-kickback laws and regulations. Intake, summarize and assess applicability of news laws and regulations and support implementation of new requirements. Collaborate with other attorneys and regulatory professionals and work closely with Compliance and business teams to identify and reduce known and potential regulatory, legal and business risks. Keep informed regarding regulatory trends and best practices and counsel business partners related to the design and implementation of measures to avoid, reduce and mitigate risks. Serve as strategic advisor to the business team and enterprise colleagues on the impact and response to proposed and new rules, regulations and legislation.

Qualification and Experience

The candidate should have a J.D. degree. Bar membership is required. Must have 6-8 years of corporate legal department or law firm experience. Should have a solid understanding of highly complex federal and state health care and insurance laws and regulations, including government healthcare programs, the regulatory enforcement environment and managed care. Knowledge of Part B a plus. Should have an in-depth knowledge of Medicare Part D requirements, Medicare fraud, waste and abuse laws and regulations, and state and federal anti-kickback requirements, including the False Claims Act, Health Care Fraud Statute, Criminal Fraud, Anti-Kickback Statute, Stark Statute, and HIPAA. Strong working knowledge of US healthcare system including federal government programs, federal healthcare laws and related state laws, such as ACA and state insurance regulations is required.
