Healthcare Senior Counsel The candidate work for a multinational company that is a market leader in industry. Will gain a wide breadth of experience (in both healthcare and industrial spaces) in a supportive environment and will play an integral role in the day-to-day needs of the legal team, as well as the Company’s business associates. The candidate will provide guidance related to healthcare commercial contracts to assure legal compliance, adherence to contract guidelines and mitigation of risk. Additionally, the candidate will work closely with the in-house team, management and sales associates on diverse subject matters, including commercial issues, and regulatory compliance. Duties and responsibilities: Drafting, negotiating, and reviewing a variety of commercial contracts in support of the healthcare related business units, including product sale agreements, group buying agreements and RFPs. Analyze business initiatives for and ensure that the company complies with applicable laws and company policies, including Anti-kickback Statute and other U.S. healthcare compliance laws and regulations, antitrust, and FDA requirements. Counseling on appropriate relationships with healthcare professionals, patients, managed care entities, academic institutions, and government entities. Advising on FDA regulatory submissions, label negotiations and privacy and data use. Interface with the company’s regulatory professionals and managers and U.S. Regulatory Agencies (and other like international agencies) on responses to healthcare regulatory matters, including notices of violations, inspections, complaints, and other enforcement and compliance matters. Assisting with training of Company personnel in contract practices and negotiation strategies. Assisting with other matters as assigned including providing support with industrial related business units.
Qualification and Experience
The candidate should have J.D. from a well-regarded, U.S. accredited law school. Must have 6+ years of experience drafting, reviewing, and negotiating commercial contracts with a law firm or in-house legal department specializing in healthcare. Should have a broad understanding of pharmaceutical/medical device industry and regulatory enforcement environment including familiarity with regulations and regulatory guidance by the U.S. Food & Drug Administration and the European Medicines Agency relating to pharmacovigilance. Experience drafting and presenting contract templates is strongly preferred. Must have current Bar membership in a U.S. jurisdiction. Must have excellent verbal and written communication skills. Should have strong interpersonal and negotiating skills. Must have excellent organizational and time management skills. Proficiency in MS Office applications and Google Suite is required.
