Marketing Attorney The candidate will assist with the review of advertising and internal training materials and various marketing initiatives for compliance with applicable federal and state regulations, including Section 5 of the Federal Trade Commissionsâ€™ Act, state UDAP equivalents, and FTC-based guidelines and frameworks. The candidate assists in the enforcement of policies related to agent solicitation efforts, including Do Not Call, CAN-SPAM, and online recruiting. The candidate is required to not only be able to comprehend complex issues, but also be adept at analyzing information and recommending viable solutions, possess a willingness to work collaboratively with team members and business counterparts to identify thoughtful and creative solutions to legal issues that arise. Should possess knowledge of federal and state advertising laws, TCPA / Do Not Call compliance, and CAN-SPAM requirements, as well as a strong ability to accurately assess these requirements against Company materials and initiatives. The role will also help to review legislation and regulations to ensure continued compliance and will handle miscellaneous projects as assigned. Review advertising materials for compliance with applicable laws and brand requirements; provide legal advice on content; provide strategic advice and review of digital/social/mobile marketing programs. Advise clients on social media issues, including disclosure requirements and guidelines. Counsel clients on trademark, copyright, and rights of publicity. Partner with publications and marketing teams on various communications, as well as ensuring compliance with disclosure requirements, applicable laws, and brand standards.
Qualification and Experience
The candidate should have Juris Doctorate Degree from an accredited U.S. law school. Must have License to practice in at least one state. Related experience in a law firm or corporate setting is preferred. Should have excellent academic credentials. Previous experience in the financial services industry is preferred. Should have outstanding interpersonal and leadership skills with proven success in building internal and external partnerships. Must have outstanding written and verbal communication skills. Series 6 and 26 securities registrations (or equivalents) required OR obtained within 90 days of hire is needed. Series 51 (or equivalent) required OR obtained within 180 days of hire is needed. Should have ability to be a strategic partner and trusted advisor for business clients. Must have ability to find practical solutions to business challenges. Must have strong negotiation and collaboration skills.
