Staff Attorney, Alternative Dispute Resolution Division The candidate will perform mediations to help parties in appellate litigation explore a broad range of opportunities to enter into mutually satisfactory settlement agreements. Will mediate a variety of complex appellate disputes. Also provide legal and administrative assistance to the Director and Deputy Director, including working with judges, lawyers, litigants, mediation participants, appropriate court personnel, other mediators, and the ADR community to mediate effectively and promote the ADR process; gathering information and resources to ensure the efficiency and effectiveness of the program. Will be reviewing case files to assess the legal posture of the appeal, the position of the parties and its appropriateness for mediation; oversee the scheduling of mediations and training. Attend mediation training, conferences and continuing education at the discretion of the director; documenting results and collecting data about the programs, procedures, mediations, mediators, training and materials. Will be conducting interviews with attorneys and parties as part of the case selection and pre-mediation process; co-mediating with Senior Judges from a variety of counties in Maryland. Assist and monitor with post-mediation follow up. Draft Orders and simultaneously be maintaining files for numerous cases. Perform all other duties as assigned.
Qualification and Experience
The candidate should have a Juris Doctorate and a member of the Maryland Bar. A minimum of two(2) years’ work experience in a legal setting and a minimum of one year experience in alternative dispute resolution. Experience with appellate litigation preferred. Knowledge of a variety of mediation practices, models and resources. Knowledge of general legal principles and/or ability to perform legal research in order to analyze complex legal issues on appeal and the posture of a case. Understanding of appellate litigation procedure. Excellent interpersonal skills with an ability to recognize complex relational dynamics between parties. Excellent interpersonal skills with an ability to work well with diverse populations. Excellent oral and written communication skills, including an ability to communicate and work collaboratively with judges, court personnel, litigants, attorneys, parties, other mediation participants, and co-workers. Ability to effectively and patiently mediate highly emotional conflicts. Ability to be flexible and rely on multiple mediation tools in order to provide a quality mediation process to all parties and mediation participants. Ability to advise the program director and deputy director with regard to both effective operation of the mediation process and of the programs. Ability to define problems, collect data, establish facts, draw valid conclusions and formulate recommendations based on the data. Ability to compose orders, memoranda, and reports using proper grammar, punctuation and spelling, which also adhere to legal standards. Ability to apply policies, procedures, rules, regulations and laws as required. Ability to initiate, collaborate, prioritize and manage multiple projects, duties and responsibilities simultaneously. Ability to perform all essential functions of the position. Must be United States citizens or eligible to work in the United States.
