Marketing and Sales Attorney
The candidate will provide legal support in connection with the development of eCommerce platforms for vehicles, parts, and services. Provide counsel regarding vehicle telematics, over-the-air updates, and subscription services. Support the development of new digital platforms and messaging and provide legal guidance. Participate on governance boards and provide legal advice and guidance regarding the development of new mobile apps, websites, and social media channels. Provide counsel and assist with the development of advertising covenants with the dealer body. Interface with Ford’s advertising agencies and product information teams to ensure alignment on advertising messages and advertising claim substantiation. Proactively identify and assess potential consumer protection risks, and work with legal, policy, and operational teams to develop risk mitigation approaches. Participate in the negotiation and drafting of marketing partnership agreements. Identify and implement opportunities to streamline business processes by leveraging legal tools. Review pricing and provide advice on dealer contests and incentives. Draft, review, and enhance warranties for existing products and emerging battery-electric vehicles. Provide legal advice regarding warranty-related proposals and interpretation of warranty policies under state and federal law. Collaborate with international legal stakeholders to develop cross-border compliant product warranties. Research and provide legal advice related to warranty reimbursement and labor rate requests under state law. Monitor the legal environment for changes in the state and federal laws governing warranties and service contracts. Provide counsel related to sales of parts to dealers and consumers. Support initiatives related to sales of used vehicles. Assist trademark team with dealer disputes involving domain names and trademark violations. Draft, review, and negotiate commercial agreements, including Master Services Agreements, Non-Disclosure Agreements, Letters of Intent, and Bailment Agreements. Stay abreast of legal developments impacting clients and provide legal education and training for clients.



Qualification and Experience

The candidate should have a J.D. from an accredited law school. Should have 4+ years at a major law firm or large corporation providing legal advice regarding commercial, digital media, marketing and advertising, or distribution-related matters and strategic initiatives. Should have 4+ years of experience in the automotive or digital media industry. Experience managing emerging technology initiatives. Familiarity with FTC consumer protection laws. Familiarity with warranty and automotive distribution laws. Ability to interact comfortably with executives and senior management. Ability to manage multiple internal stakeholders and balance differing opinions and perspectives. Strong verbal and analytical skills. Exceptional interpersonal skills. Highly team-oriented. A commitment to professionalism. Flexibility as to the types of projects assigned. Solid business acumen. The ability to manage several simultaneous projects under deadline pressure. OEM experience is a plus.
