Senior Corporate Counsel - IP
Duties: Conduct and maintain updated freedom to operate (FTO) analyses related to chemical syntheses / methods of manufacturing active pharmaceutical ingredients (API), and API composition of matter patents. Advise scientific teams during the R&D process for new generic API products, and the provision of fee-for-service medicinal chemistry, biology, and chemical development R&D to pharmaceutical industry customers. Assess potential new internal IP for future patenting strategies. Assess IP-related potential conflicts of interest. Assist in managing existing IP portfolio, including assessing IP for maintenance, and coordinating annuity/annuities payments with outside vendors and outside counsel. Assist in Hatch-Waxman / PIV-related matters with respect to customers’ ANDAs. Manage patent assignment processes for customer-owned IP. Develop and implement formal internal invention disclosure process. Advise the business on various intellectual property matters, such as validity, infringement, enforceability and related issues. Conduct periodic trainings for scientific staff related to IP matters.

Qualification and Experience

Qualifications: JD Degree from an accredited law school; licensed to practice in a U.S. jurisdiction; or, qualification as a European Patent Attorney. 5-8 years of relevant experience at a leading law firm, and/or in-house legal department in the pharmaceutical or life sciences industry. An excellent ability to: grasp legal and business issues quickly; balance risks; exercise sound judgment; and provide practical, constructive and timely counsel in a growing, dynamic, entrepreneurial and fast-paced business environment. Experience advising brand and/or generic pharmaceutical clients on patent strategies and related intellectual property matters. Experience with US and European patent prosecution. Familiarity with the New Drug Application (NDA) and Abbreviated New Drug Application (ANDA) process. Strong work ethic and ability to multi-task and effectively manage a high volume workflow. Strong organizational skills, detail oriented, innovative, strategic, self-motivated and able to motivate others. Excellent verbal and written communication skills, and a desire and ability to build strong working relationships with internal clients and business partners. Preferred Advanced degree in chemistry, or equivalent experience, strongly preferred.
