Strategic Coverage Counsel - General Liability The candidate must be a seasoned coverage attorney with substantial experience in third-party lines of business, including, but not limited to commercial general liability, construction defect, life sciences, mass tort, workers compensation, and commercial auto coverage issues. Should preferably have 8-10 years of experience either in an in-house position handling claims of the highest severity, or in a law firm providing legal advice and litigating third-party insurance claims of the highest severity and complexity. Our ideal candidate will possess top-tier legal research, analytical, communication, and coverage skills. Will accept referrals of complex coverage matters and other claim-related legal issues from CNAâ€™s Commercial Claim organization. Provides legal and strategic analysis and advice to claim teams and other internal business partners with respect to complex coverage issues the potential impact of coverage on overall claim exposure and legal risks by researching and analyzing issues in both litigated and non-litigated matters. Partners with claim professionals in developing and executing strategies for handling claim related legal issues that range from simple low impact to complex multi-faceted and high impact. Manages and oversees coverage litigation and serves as the decision point for engaging external counsel including selecting and working with counsel and assisting with the preparation and editing of briefs and other substantive filings and communications. Develops written and verbal communications regarding coverage with our customers their counsel claimantsâ€™ counsel and others. Develops and drives execution of negotiation strategies for coverage matters. Facilitates claim resolution by engaging directly with customers claimants and other insurers through mediations settlement conferences and other forms of alternative dispute resolution and assessing each sideâ€™s position to the desired outcome. Partners with Claim Underwriting and Product Development teams to develop supplement and revise policy language. May participate with Senior Management in the development and implementation of claims and business policies. Maintains big-picture perspective while identifying and executing critical strategies and priorities for complex claim related legal issues. Educates key stakeholders by providing ongoing formal and informal coverage training to our claim teams and other internal business partners. Tracks legal and regulatory changes and advises claim teams and other business partners of the impact of such changes. May perform additional duties as assigned. Bachelor's degree with JD and admission to the Bar of one state. Typically requires a 10+ years of coverage experience with a law firm and/or insurance carrier with increasing level of responsibility. May require specific technical/functional area legal experience.
