Assistant General Counsel The candidate will serve as one of the attorneys who manages asbestos litigation, product litigation, and commercial litigation matters; develop strategies to resolve and/or manage pre-litigation matters in the US; work with national coordinating counsel and local attorneys globally on litigation and pre-litigation matters in the US; work with attorneys in other regions within the legal department, as needed, and work collaboratively with other members of the litigation team. Retain and supervise outside counsel while managing strategic defenses or prosecution of the Company’s legal position and having oversight responsibility for the litigation and defense budgets for geographic areas of responsibility for asbestos, product and negligence litigation dockets. Monitor and direct outside counsel and negotiate successful resolutions by actively participating in settlement conferences and mediations. Provide critical reporting and guidance to senior business leaders regarding risks and likely outcomes for all assigned litigation and pre-litigation matters. Forecast trends in various litigation categories and track amounts paid to resolve lawsuits/claims as well as legal expenses incurred in such proceedings. Direct, manage and implement strategies for cost control and cost effective use of resources. Provide guidance to internal and external auditors and to Deputy General Counsel - Litigation regarding the establishing of reserves for legal contingencies in assigned litigation matters. Work closely with risk management group and insurers, where appropriate, throughout the litigation process. Direct and manage Third Party Administrator in claims management of insured claims against the Company. Interact closely with business, legal and engineering colleagues to investigate pre-litigation claims and avoid litigation, where possible. Advise senior management regarding settlement of disputes or litigation matters and work closely with Sector and Company finance teams and Risk Management team regarding settlement of outstanding disputes of litigation matters. Must have 8-10 years of experience. Should have JD degree from an accredited US or Canadian law school. Good standing member of a State Bar Association is essential. Must have 6+ years of experience defending/managing asbestos litigation docket. Should have experience in defending and/or managing complex litigation. Trial experience is essential. Should have experience in litigation project management to direct the cost-effective deployment of resources. Must have experience and/or familiarity with insurance coverage for litigation and/or claims. Proven experience working in a company or law firm and demonstrated strong business acumen is essential.
