San Jose office of our client seeks Senior Employment Attorney with 24 years of experience. The candidate will conduct employment diligence and advise on employment aspects of corporate transactions. Will draft and negotiate employment, retention and related agreements. Advise on reductions in force and other employee terminations. Draft restrictive covenants and counsel on employee mobility, conduct employment investigations, provide advice and counsel to emerging companies in all aspects of employment law, including compensation practices, commission plans, and leave practices. Provide day-to-day advice to fast-growing technology companies on all aspects of employment law (terminations, leaves of absence, reviewing and drafting policies) as well as employment mobility issues (trade secrets, non-competes, and employee solicitation). Must be experienced with NLRA, collective bargaining and union campaigns, grievance and arbitration. FLSA and state analogues; Title VII of the Civil Rights Act and state FEP statutes; FMLA; ADA; ADEA; WARN Act; employment litigation (torts, contracts); OSHA and/or law firm experience are a plus. Should preferably also have counseling and employment litigation experience.
