Labor and Employment Attorney
The candidate under the direction of the Vice President, Legal you will partner with the Human Resources team and business operations to provide employment-related legal advice and services for the Company. Will also manage labor relations and contract negotiations, grievances and arbitrations. This position requires employment law experience, including experience conducting internal investigations and drafting EEOC and state agency position statements. Also requires experience with multiple unions. Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions: Investigate and defend state and federal charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents; Conduct internal investigations related to employment law and corporate compliance matters; Support VP, Legal in research, advice and counsel related to employment laws and regulations; Manage employment related litigation matters and oversee outside counsel on such matters; Support HR team in labor relations matters such as the negotiation of collective bargaining agreements, handling of union grievances, labor arbitrations, and ULP charges, implementation of union avoidance best practices and respond to labor organizing campaigns; Support the drafting of employment, settlement and separation agreements; Support employment related hotline investigations; Assist in development and presentation of education and training materials to HR and business stakeholders; Assist in employment-related aspects of company special projects such as mergers/acquisitions, as well as reductions in force and location closings (e.g., severance, WARN Act); Support preparation of materials for quarterly reporting up of employment law and compliance matters to senior executive leadership and Compliance team.

Qualification and Experience

The candidate should have Juris Doctorate degree (J.D.) from an accredited law school. Must be licensed to practice law in at least one state with the ability to become licensed in Utah. Should have 5 years of employment law experience. 5 years of labor relations/contract negotiation experience is required. Must have experience investigating and defending state and federal charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents. Experience conducting internal investigations is required. Should have exceptional written communication skills. ,j exceptional attention to detail, and strong organizational and problem-solving skills. Wage and Hour/FLSA experience is needed. Should preferable have Post-acute care experience. Experience in a multi-state, multiple facility environment is desired.
