Vice President Intellectual Property
Duties: Provide strategic direction to project teams regarding freedom-to-operate and IP protection issues including responsibility for patent application preparation and prosecution. Assess brand product opportunities at all stages of product development from initial opportunity assessment and project prioritization through development and implementation of IP and R&D strategies for products. Participate as needed in IP due diligence activities for M&A opportunities, independently prepare/review and negotiate a variety of agreements, and collaborate with and provide strategic direction to Regulatory Affairs on IP issues impacting regulatory approvals and life cycle management. Support IP-related litigation, particularly Paragraph IV litigation. The attorney in this position will also be required to study and report on possible infringement of company patents and trademarks by competitors. Bring innovative ideas to the executive team and act as a partner to the Chief Scientific Officer in developing intellectual property strategy. Establish strong working relationships with the executive team and other functional areas in a highly collaborative environment. Attract, retain and develop a high performing team.

Qualification and Experience

Requirements: BS/BA degree in chemistry, chemical engineering, biochemistry, pharmacy, or a related scientific/engineering field required. JD Degree or LLB from an accredited U.S. law school is required. An advanced degree: MD, PhD or PharmD preferred. Admitted to practice law in at least one U.S. state and eligible for admission in New Jersey. 15+ years’ experience including experiences as principal IP counsel for a pharmaceutical and/or medical device company. Experience as in-house counsel is required. Admitted as a patent attorney to practice before the USPTO. Expertise in Hatch-Waxman issues Proven intellectual property and patent portfolio development and management skills. Patent bar membership A leader with a thorough knowledge of the drug and device development process and laws and regulations affecting the device and pharmaceutical industries globally. Leadership experience with a progression in responsibilities and people management. Strong analytical skills and be a creative thinker – able to identify, develop and execute sound legal and business strategies. Can demonstrate business acumen and experience partnering with senior business leaders across key functional areas such as R&D, commercial business groups, business development & portfolio strategy, M&A, and the like. Excellent cross functional and team building skills strong influence leadership abilities. High sense of urgency, high-energy, comfortable with ambiguity and has a strong sense of accountability. Excellent communication, presentation, written, and verbal skills. Ability to see the long range vision and develop supporting strategies for intellectual property and patent management.
