ProfileVice President, Intellectual Property The candidate will develop, manage and lead a comprehensive IP strategy for MyoKardia. In this position, you will have the opportunity to build an IP department and provide leadership for the company in all intellectual property-related matters. Advise senior management and the Board of Directors on IP strategies, including what can and should be protected, where patents should be filed, and risks and opportunities associated with business development transactions. Formulate and implement policy for US and foreign patent applications and patent term extension applications on a global basis. Develop processes for protection of intellectual property and work closely with research and development (and, eventually, commercial) personnel to identify patentable inventions, participate in invention disclosure assessments and provide guidance regarding the patentability of inventions under review. Advise project teams on IP-related matters. Monitor, evaluate and address competitor and other applicable third party IP rights and advise senior management on the implications of such rights, including evaluating the validity of competitor patents. Manage outside counsel in the preparation and prosecution of patent applications and provide technical and legal expertise to maximize the quality of applications. Plan for building in-house capability to prepare and prosecute patent applications. Lead any opposition, IPR or similar matter and advise on any IP litigation. Develop and implement publication and disclosure strategy and processes. Train firm employees with respect to IP policies, importance of IP protection and patent and trade secret-related matters. Interact with counterparts in corporate research and development partnerships and advise on implications of IP terms of collaboration and other important transactions. Manage IP budget and set priorities for investment in intellectual property portfolio.
Qualification and Experience
The candidate must have advanced degree in chemistry or related science and JD from an ABA accredited law school. Admission in good standing to any State Bar and to the USPTO. Should have 12+ years of industry experience in a law firm and/or in-house with drafting and prosecuting patent applications and developing a strategic patent portfolio as well as some experience building a team and managing other IP professionals and a department budget. Knowledge of drug life cycle management and role of IP strategy in life cycle management is required. Experience working with C-level management and Board of Directors is needed. Scientific experience in areas relevant to the development of small molecule pharmaceuticals and experience with business development transactions is desired.
