Senior Assistant City Attorney
The candidate manages the operations of the Litigation Unit of the General Counsel Section and makes policy, procedure, planning, and process decisions in order to achieve annual goals, objectives, and work standards under the general direction of the City Attorney. May exercise direct and/or indirect supervision over Legal Specialist, Legal Assistant, Paralegal and Attorney members of the litigation unit. Represents the City in state and federal court cases at both the trial court and appellate levels such as §1983, negligence, employment, eminent domain, and election law cases. Acts as a legal advisor to all levels of City government and performs legal research. Provides a wide range of professional legal services, including litigation services (Litigation Duty Assignment), to the Mayor, City Council, City Manager, City departments, and various boards and commissions of the City. Manages the operations of the Litigation Unit of the General Counsel Section (Litigation Duty Assignment) by making daily policy and procedures decisions; and develops, implements, and evaluates plans, work processes, systems and procedures to achieve annual goals, objectives, and work standards under the direction of the City Attorney. Manages staff by planning and prioritizing tasks, ensuring policy and procedure compliance, recommending changes and adjustments, and monitoring staff performance and development. Advises City Council, management, and department staff and Boards and Commissions on legal questions and procedures in various aspects of municipal law. Initiates, negotiates and drafts agreements, development agreements, franchise agreements, leases, contract ordinances, contracts, and other legal documents and / or memoranda; reviews procurement contracts and bids. Analyzes, evaluates and legally resolves issues. Drafts documents, such as resolutions, ordinances, licenses, easements, letters, escrow accounts and agreements, etc. Establishes and accomplishes yearly goals and objectives (and training plan) and meets yearly Continuing Legal Education course requirements. May represent City in assigned areas of practice in state and federal courts and, if applicable, before boards, commissions, and administrative bodies. Investigates case allegations. Prepares written legal positions, conducts research, and prepares supporting memoranda. May prepare witnesses for depositions, trial, and / or administrative hearings so that they are comfortable testifying and understand the procedure. Takes depositions and other sworn testimony relating to on-going cases. Tries cases. May provide Risk Prevention advice. Advises the Claims Coordinator, the City Attorney, and the Chief Assistant City Attorney regarding liability claims, which includes providing input for settlement. May attend Executive Session with the City Attorney or Senior Deputy.

Qualification and Experience

The candidate should have a J.D. degree from an ABA accredited law school, 6+ years of litigation experience, and membership in good standing in the State Bar of Arizona. Municipal law or other government experience, admission to the United States Supreme Court, and 3+ years previous supervisory experience over other attorneys is preferred. Should have, or obtain within three months of hire, admission to the Ninth Circuit Court of Appeals (Litigation Assignment) and the US District Court for the District of Arizona (Litigation Assignment). Experience in a municipal or government setting is preferred. Prior supervisory experience of other attorneys of 3+ years is desired. Admission to the Bar of the United States Supreme Court (Litigation Duty Assignment) needed.
