Attorney- In-house Counsel- HIPAA and Compliance
The candidate will ensure the legality of health care compliance activities, HIPAA, and the release of records through research and regular review. Leads and develops risk management strategies. Subject Matter Expert in Stark Law, Anti-Kickback Statute, and other Healthcare Compliance areas. Provides opinions and legal guidance on compliance-related matters, as assigned. Routinely monitor the state of Wisconsin and federal HIPAA regulations. As new regulatory compliance requirements come up, the compliance officer will work to proactively modify the organization’s HIPAA compliance program to accommodate these changes. Demonstrate a thorough knowledge of applicable privacy and security solutions and maintain a thorough HIPAA compliance program. Provides legal oversight regarding healthcare compliance and risk management activities. Drafts and administers various contracts, operating agreements, and employment agreements. Creates, modifies, updates, and implements the Company’s policies and procedures meant to ensure compliance with applicable laws, regulations, and standards. Develops, reviews, and manages written policies and procedures that establish standards for compliance with applicable laws, regulations, and accreditation standards, which may include Medicare and Medicaid reimbursement, NCQA, HIPAA, ADA, OSHA, etc. Conducts research, anticipating and guarding the company against legal risks. Develops risk management strategies. Conducts periodic tests, audits, or inspections of organizational processes or facilities and reports findings to management, interprets findings and recommends and implements corrective action as needed. Conducts initial reviews of alleged compliance and privacy violations and escalates to General Counsel for review. Guides the development of annual compliance education programs. Oversee, direct, and deliver privacy training and orientation to all employees. Create and monitor BAAs to ensure that all BAs are maintaining privacy requirements and responsibilities. Track access to PHI so that it can be reviewed during audits. Maintains responsibility for the management of all ongoing activities related to the development, implementation, maintenance of, and adherence to the organization's policies and procedures covering the privacy of and access to patient health information. Ensure compliance with federal and state laws and the healthcare organization's information privacy practices. Work with the release of information team when issues related to medical records arise. Lead the implementation and operations of auditing and monitoring compliance processes, including HIPAA processes. Work in a safe, compliant, and ethical manner at all times. Respect and maintain confidentiality.



Qualification and Experience

The candidate should have Juris Doctor (JD) Degree. Must have 3+ years of applicable experience. Background in contract law and real property law preferred. Background in healthcare law preferred. Knowledge and experience related to health care compliance, HIPAA, and the release of records are a plus. Must have current license to practice law.
