Wms2 Supervising Staff Attorney The candidate will provide legal consultation and administrative hearing representation based on expert legal education and experience to either the Medicaid Program or the Employee Retiree Benefits (ERB) Division within HCA. This position serves as the agency's legal subject matter expert on employee health benefit plans, self-insurance plans, COBRA, ERISA, self-insurance health plans, and/or Medicaid programs and works directly with the State Attorney General's Office in regards to litigation in which the agency is involved. The position also serves as an additional legal resource to conduct research and analysis of, and consider and make decisions on, disputes related to overpayments, vendor protests, provider agreement terminations, and provider rates. Will manage and lead a team of employees within the established personnel rules and be responsible for coaching, training, and performance evaluation of individual team members. Provides legal consultation to appeals staff and may directly present recommendations to various programs within HCA or represent HCA during formal administrative hearings. The position provides legal consultation based on expert legal education and experience to the Section Manager, Director of the ERB Division, Medicaid Director, Chief Legal Officer (CLO), and other agency executives primarily regarding employee benefit program issues. This position provides research, advice and written legal analysis and oral presentations on a variety of other subject matters including contracts and acquisitions; vendor disputes; Open Public Meetings Act; and the Administrative Procedures Act. The position advises either the ERB Division or the Medicaid Program as to their legal obligations and risks in coordination with the Attorney General's Office, and assists in writing Washington Administrative Code (WAC) and administrative policies and procedures. The position performs legislative bill analysis during the legislative session and may assist in the development of agency request legislation. This position may also provide assistance in contracting and procurement and other duties as assigned. Provides legal consultation based on expert legal education and experience to appeals staff related to hearings and appeals. Represents HCA in complex administrative hearings as assigned by the Section Manager before an HCA Presiding Officer or before the Office of Administrative Hearings in accordance with agency rules, the Washington's Administrative Procedures Act, and all state and federal laws. When acting as an agency hearing representative, this position must prepare all legal pleadings and documents, prepare witnesses to testify in hearing, respond to Appellant's legal arguments and pleadings, and present the Agency's position at hearing. Thoroughly research and apply laws, rules, policies and procedures in a majority of the subject areas mentioned in the Position Objective. Competently draft legal documents, rules, correspondence, position papers, training materials, policies and procedures appropriate to various audiences and purposes. Review complex legal and technical documents, identify key issues and points, explain them to others in plain English, and make policy recommendations. This includes legal case analysis, identifying options and formulating recommendations for resolution. Effectively advise and consult with the DLS management team and the assigned HCA program area regarding specific cases or the consistent application of state and federal law, policy and procedures. Effectively manages employees within the established personnel rules, policies, procedures, and collective bargaining agreements as appropriate. Provides legal consultation based on expert education and experience, in coordination with the Attorney General's Office, to HCA staff regarding a wide array of issues dealing with public employee benefits, including COBRA, ERISA, Internal Revenue Code, self-insurance health plans, outside third party administration issues, coordination of benefits, long-term disability, health savings accounts, flexible spending accounts, and/or Medicaid related programs. Act as liaison the Attorney General's Office on assigned program area related legal matters and in civil litigation. Coordinates the assigned HCA program area litigation defense strategy, and/or assist with discovery, as directed by the Section Manager. Materially contribute to identifying risk management strategies, proposing and drafting of technical requirements, and terms and conditions for contracts and competitive bidding processes involving the acquisition of medical, dental benefits, or other employee benefits for current and retired WA government employees and/or Medicaid eligible clients. Participates as part of the assigned program area legal team, reviews draft rules, and recommends changes to rules or policies to mitigate agency risk and to comply with state and federal law. May conduct contract disputes, vendor protests, public records denials, provider agreement terminations, and provider rates disputes. Represents the Health Care Authority to internal or external entities (e.g., the Department of Enterprise Service, Office of the Attorney General, Department of Retirement Services, Office of the Insurance Commissioner, and the Office of Financial Management, PEBB, Heath Benefit Exchange) on legal or health policy matters of significance to the assigned program area. Maintain appropriate levels of confidentiality and compliance with applicable statutes, rules, HCA policies, and program procedures.

Qualification and Experience

A Juris Doctor degree from an ABA-accredited law school is needed. Should have 2 years' experience providing legal consultation to diverse clients with diverse interests, preferably government agencies, on complicated legal issues. Must have knowledge of Washington laws and rules pertaining to records retention, public disclosure and civil litigation and discovery. 2 years' litigation experience either in administrative law or a court of law is needed. should have knowledge of Medicaid and public health/assistance programs. Preferred/Desired: Knowledge of the Washington state legislative process. Knowledge of the federal Affordable Care Act and its anticipated effects on state agencies which procure and provide health benefits. Knowledge about Health Savings/Spending Accounts. Experience drafting agency policies and procedures. 3 years' experience in the health insurance industry, including health benefits contracting and benefits procurement. 2 years' experience in the health insurance industry. Must have experience analyzing legislation; experience and demonstrated comfort working in a fast-paced environment while serving diverse clients with diverse interests; ability to problem solve, prioritize workloads, meet due dates, and provide independent strategic direction/decision making; exceptional oral and written communication skills. Will be able to: Handle customer questions and complaints in a pleasant and professional manner; demonstrate strong interpersonal communication skills; give the appropriate attention to detail, show a commitment to excellence, and regularly strives for quality improvement. Will also be able to listen to others, positively contributes to and promote a team atmosphere.
