SALARY RANGE: $119,387.00 - $220,397.00 Annually

SUMMARY OF POSITION:

The NYC School Construction Authority (SCA) Vice President (VP) and General Counsel reports to the President and Chief Executive Officer (CEO) and is responsible for advising the SCA on all legal issues and matters. The VP/General Counsel directs the activities of the Legal Department including Litigation and issues/matters involving Construction, Real Estate, Procurement and Contract Administration, Labor and Employment, Labor Law Compliance, and the SCA Owner Controlled Insurance Program.

DUTIES AND RESPONSIBILITIES:

  • As member of the SCA Leadership Team, participates in the development, implementation and maintenance of policies, practices, and procedures that impact various SCA divisions; regularly attends Leadership Team as well as Trustee meetings where policy is discussed and developed
  • Provides general legal interpretations, direction and guidance to the SCA on all phases of the construction process to identify opportunities for maximizing the effectiveness of SCA operations in areas including contract negotiation, contract management, and contract dispute resolution.
  • Provides legal direction for the SCA in the property acquisition and leasing processes.
  • Ensures the effective representation of the SCA in all ongoing litigation.
  • Facilitates Labor-Management committee meetings to address matters related to collective bargaining
  • Works with the human resources department to address internal and administrative charges of employment discrimination and other, similar matters.
  • Provides legal direction and guidance in the development of all SCA administrative policies and procedures to protect the interests of the SCA and minimize risks.
  • Ensures the SCA is appropriately insured and oversees the management of the SCA Owner Controlled Insurance Program.
  • Ensures the transfer to the NYC Department of Education of all facilities in a manner consistent with legal requirements.
  • Provides legal direction to ensure SCA compliance with statutory and regulatory environmental guidelines.
  • Initiates and maintains effective external relations at the state and city level, both executive and legislative, to ensure that effective advocacy occurs and to maximize support for SCA programs.
  • Reviews and provides feedback on proposed state and city-proposed legislation.
  • Plans, assigns, monitors, reviews and evaluates the work performed by Department staff and makes recommendations regarding recruitment, hiring, promotion, reassignment and discipline.
  • Prepares resolutions and other material for the SCA Board of Trustees and Civil Service Commission.
  • Manages review of and response to Freedom of Information Law requests.
  • Performs related tasks.

MINIMUM QUALIFICATIONS:

  1. Juris Doctor degree from an accredited law school; and
  2. Admitted to practice law in New York State; and
  3. Fourteen years of full time diverse legal experience, subsequent to admittance to practice law, in real estate law, litigation and/or construction contracts; seven years must have been in a managerial or executive capacity ; or
  4. A satisfactory combination of education and experience; however, qualifications #1 and #2 are required.

BACKGROUND

The SCA is the organization responsible for building new public schools and managing the design, construction and renovation of capital projects in New York City's more than 1,200 public school buildings, half of which were constructed prior to 1949.  The SCA is dedicated to building and modernizing schools in a responsible, cost-effective manner while achieving the highest standards of excellence in safety, quality, and integrity.

The SCA's Legal Department provides legal services to all divisions and departments of the SCA. The Department's responsibilities include: ensuring that the SCA is in compliance with its statutory and legislative mandates; managing litigation against the SCA; drafting and negotiating SCA contracts, memoranda of understanding, and other legal documents; site acquisition through negotiated purchase, eminent domain, or leasing; mediating claims and disputes; processing tort claims through the SCA's insurance programs; handling Freedom of Information Law (FOIL) requests made by the public; advising the Board of Trustees, officers and employees of the SCA and Department of Education (DOE) regarding all legal requirements of the SCA's construction program and business operations; and providing advice and assistance to employees with respect to their obligations under the City's Conflicts of Interest laws.
