Legal - Assistant General Counsel - Mortgage Banking Servicing – VP The candidate will: Be in the Mortgage Banking Servicing and Default legal group Help maintain compliance with all applicable state and federal laws and regulations impacting the mortgage servicing business. Work cooperatively with the Compliance Department to keep up with all changes to the laws and advise the relevant LOBs of changes in a timely manner. Assist the relevant LOBs with drafting and implementing policies and procedures to assure compliance with applicable laws, regulations, and investor requirements. Provide legal advice and ongoing support for performing servicing operations. Provide legal advice and ongoing support for customer assistance servicing operations. Advise senior management within the Legal Department and LOBs of servicing risks within the organization and help devise practical solutions for any issues raised.
Qualification and Experience
A J.D. degree or equivalent and admitted to practice law in the United States, required. Must have 5 years of experience practicing law post-JD. Should have 5+ years of experience in the legal department of a mortgage servicing area at a large bank, mortgage servicer, relevant regulatory entity, or law firm. Must be licensed to practice law and a member in good standing in in the state/jurisdiction in which the position is based or otherwise in compliance with the in-house counsel registration rules of that state/jurisdiction, Experience working closely with banking regulators and managing examinations is needed. Should have extensive knowledge of federal and state laws impacting mortgage servicing such as TILA, ECOA, FCRA, FDCPA, RESPA, the Fair Housing Act, the Homeowners Protection Act, and predatory lending laws. Must have in depth understanding of FHA, VA, USDA, GSE, and HAMP servicing rules. Should have ability to prioritize work, effectively manage a large number of issues at one time, and interact effectively with senior management.
