Default Title And Litigation Coordinator The candidate will manage a caseload of contested, litigated, adversary, and escalated legal case matters on foreclosure and bankruptcy actions. Manage a caseload of title defects, condo/HOA/cooperative and other escalated matters encountered during Default Servicing. Provide oversight for service released contested, litigated, and adversary actions on tendered defense case matters. Research and assess case merit to establish defense strategy or settlement. Perform and review title research, including land records, title commitments, and court dockets, to assess title defects and potential resolutions. Analyze title defects in connection with title policies (ALTA 10-17-92 and ALTA 6-17-06), closing instructions, closing protection letters, and other closing documents to determine necessary action to clear titles. Negotiate settlement of escalated HOA/condo/cooperative delinquencies to protect the interest of the Bank or investor. Provide corporate testimony or witness on behalf of the Bank during case depositions, trials, settlement conferences, mediations, and other court appearances or legal matters. Establish loss reserves based on case merit, risk, and prevailing vantage point. Prepare case summaries, loss analysis, proposals, and recommendations for resolutions. Coordinate with senior management, Corporate Legal, and attorneys for decisions and resolutions. Review loan documents to determine liability of originators or other applicable parties for title curative work under the respective terms of contracts and agreements to minimize exposure to the Bank or investors. Analyze priority of the Bank’s security instrument under applicable state law and possible defenses to adversary’s position based on equitable subrogation or other legal theory. Analyze and exercise recourse options with prior servicer and the Portfolio Development team. Assess and coordinate real property title conversion requirements on manufactured homes, modular homes, or mobile homes in accordance with applicable laws. Negotiate and provide oversight for settlement with title insurance companies, adverse, and third parties through to resolution. Examine, negotiate, and authorize legal bills from attorney firms. Oversee case workflow, progression, and attorney firm overall performance and effectiveness. Facilitate discussions with prior and existing servicers regarding case strategy, risks, and settlement proposals. Interpret, articulate, and apply government guidelines, Consumer Financial Protection Bureau (CFPB) mortgage servicing rules, and other regulatory requirements. Establish partnership with Corporate Legal group and provide support on legal case matters. Negotiate settlement proposals with engagement of other departments to minimize risks (loss mitigation workout options). Draft discovery responses, interrogatories, and validate settlement agreements for outside counsel on behalf of the Bank or other investors. Research and provide response with supporting document for issuance of repurchase demands made to sellers of defective mortgages. Manage timeline diligence, system updates, and tracking (Serengeti, MSP, and Bankruptcy/Foreclosure (BK/FC) LoanSphere) through resolution. Assist in training, coaching, and guidance for all new hires and any remedial training requirements. Provide guidance to team members as needed. Draft response to external audits and loan level reviews. Assist Default Litigation Manager and liaise with retained counsels on special projects. Must have knowledge of endorsements to lender’s title policies. Knowledge of non-judicial and judicial foreclosure processes required. Should have knowledge of legal descriptions used to identify real property (meets and bounds, and plat descriptions). Must be proficient levels of Microsoft Word, Excel, PowerPoint, and other related working knowledge skills. Bachelor’s degree in financial or legal related field or 7 years related experience required. Paralegal certification preferred. Should have 5 years of title curative experience. Default related legal mediation experience a plus. Must have 5 years of mortgage servicing foreclosure, bankruptcy, and/or title experience. Should preferably have 5 years of legal/courtroom experience. Demonstrated leadership experience preferred. Must have extensive knowledge of Black Knight Financial Services (BKFS) MSP, BK/FC LoanSphere, Invoice Management systems, PACER, Bankruptcy Docket and Trustee websites.
